A settlement has been reached in a class action lawsuit alleging TitleMax of Texas Inc., which provides title loans to consumers, illegally obtained private information about consumers from the Texas Department of Motor Vehicles.
If your name and address were obtained by TitleMax from a Texas motor vehicle record, you may be entitled to a cash payment from the TitleMax class action settlement.
Plaintiff Dexter Sistrunk alleges TitleMax employees violated the federal Driverโs Privacy Protection Act by obtaining consumer information including names, addresses and vehicle information from the Texas DMV.
โBeginning in the summer of 2012, Defendants began engaging in a pattern of accessing state motor vehicle records to obtain information about consumers who had previously obtained title loans from other companies for purposes of marketing its services to these potential customers,โ the TitleMax class action lawsuit says.
TitleMax allegedly used this information to contact consumers, without their consent, in order to solicit future business. Obtaining this information for the purpose of soliciting new customers constitutes a violation of the DPPA, according to the TitleMax class action lawsuit.
The defendants deny the allegations but agreed to settle the TitleMax class action lawsuit to avoid the uncertainty and expense of ongoing litigation. The TitleMax class action settlement was preliminarily approved on Oct. 25, 2017.
The deadline to opt out of or object to the TitleMax class action settlement is Dec. 22, 2017.
Whoโs Eligible
Class Members of the TitleMax settlement include anyone whose name and address were obtained by the TitleMax defendants from a Texas motor vehicle record, through searching PublicData.com and/or DataTrax websites.

Proof of Purchase
Class Members must file a valid Claim Form that includes all of the required information. Class Members must also submit a signed substitute IRS Form W-9 with their tax identification number and a copy of their government-issued photo ID card.

I believe my attorney has settled my case with titlemax and heโs not letting me know
I had loan payed it off then received letter in mail . I also was contacted by law firm from Texas last year and havnt heard a thing considering filing claim against them
I took out a title loan from titlemax in 2021 and wasnโt notified until mid 2023 that there was a data breach with this company in February of 2023. My personal and drivers license information was affected. This titlemax company is in Corsicana, Texas.
We took out loan a couple years ago and got notified this year of data breach still nothing from company
We took out a loan in Kansas, same problem still canโt pay it off.
