Terminix International Company Limited Partnership has agreed to settle a class action lawsuit alleging it made automated and/or prerecorded calls to consumers’ cell phones without their consent, in violation of the Telephone Consumer Protection Act.
If you received an autodialed and/or prerecorded call from Terminix on your cell phone between Aug. 22, 2012 and July 28, 2017, you may be entitled to benefits from the TCPA class action settlement.
According to the TCPA class action lawsuit, Terminix is one of the largest pest control companies in the world, and it operates in 47 states throughout the United States.
“In an effort to increase its bottom line and garner market share in the pest control industry, Defendant engaged in a systemic marketing campaign involving artificial or prerecorded voice calls – commonly known as ‘robocalls’ – to consumers’ cellular telephone numbers regarding the sale of Terminix services and/or the renewal of Terminix annual protection plans,” plaintiff Tomorrow Black-Brown alleges in the Terminix class action lawsuit.
However, Black-Brown says Terminix did not obtain consumers’ prior written express consent for these calls. Instead, the pest control company allegedly used an autodialer to contact the telephone numbers of consumers who may have previously purchased services from Terminix but who are not current customers and/or who did not purchase a Terminix renewable annual protection plan.
“As a result, many consumers received the above-described autodialed calls to their cellular telephone numbers from Defendant, despite the fact they did not provide prior express consent and/or have no business relationship with Defendant,” the Terminix TCPA class action lawsuit states.
Even after customers attempted to opt-out of the robocalls, Terminix continued making the autodialed calls to their cell phone numbers in violation of the TCPA, Black-Brown alleges.
Terminix denies that it violated the TCPA but the company has agreed to settle the TCPA class action lawsuit to avoid the cost, risk and delay of trial. The Terminix class action settlement was preliminarily approved on July 28, 2017.
Class Members who wish to opt out of or object to the Terminix TCPA settlement must do so no later than Dec. 26, 2017.
Who’s Eligible
Class Members include anyone who may have received an autodialed and/or prerecorded payment and/or debt collection call on their cell phone from Terminix between Aug. 22, 2012 and July 28, 2017, and who did not provide consent (or who revoked their consent) to receive such calls.

N/A. Class Members must provide the cell phone number(s) that received the autodialed Terminix call(s), and verify that the cell phone number was assigned to them at the time they received the call(s).

Really, who knows what specific date they started and ended service with a cell phone company over the last FIVE years? OR what date I texted Terminex to stop texting me, FIVE YEARS ago?! There is no way that anyone has any of this information, so I assume nobody is going to file along with the original litigant. I assume that Terminex has no records or proof of whom they texted or the cell numbers of the people who texted them back to stop text messages to their cells, either. Since there is no place to enter your phone number to see if they called my number at any given time for the last FIVE years, there is no way to tell either way.
So many unsolicited calls, so little information. What phone number were the calls from? A lot of the time it pops Unknown Caller, so there is no way to check back thru my cell records without an actual number to check for…
