Mutual Pharmaceutical Company Inc. has agreed to pay $2 million to settle a class action lawsuit alleging it conspired with King Pharmaceuticals Inc. to prevent and delay generic competition to the muscle relaxant Skelaxin, resulting in artificially high prices and depriving Class Members of full and free competition in the Market. If you operate a business outside of Tennessee and indirectly purchased Skelaxin for resale between Nov. 4, 2005 and Aug. 5, 2014, you are a Class Member of the Skelaxin class action settlement.
King is the manufacturer of Skelaxin. The class action lawsuit alleged King conspired with Mutual, a generic drug maker, to delay the release of a generic version of Skelaxin, causing purchasers to pay an artificially inflated price for the drug. The Skelaxin class action lawsuit sought a judgment requiring Mutual to pay compensatory damages and restitution. Mutual denies the allegations but agreed to settle the Skelaxin class action lawsuit to avoid the expense and uncertainty of ongoing litigation.
Who’s Eligible
Class Members of the Skelaxin class action settlement include: “All persons and entities in the United States that operate a business outside Tennessee and indirectly purchased Skelaxin for resale at any time during the period Nov. 4, 2005 through and until Aug. 5, 2014.

Potential Award
None. Due to the large number of Class Members affected by this Skelaxin class action settlement, direct cash distribution is not possible. Instead, contributions will be distributed on behalf of the Class to charitable, nonprofit or governmental organizations that benefit Class Members and promote the objectives of the antitrust laws.
Class Members may nominate organizations to receive payment from the Skelaxin settlement. Nominations by Class Members are due by Oct. 4, 2014, and proposals from organizations must be submitted by Oct. 19, 2014.

Hi, I have used this drug for about 5 years. It was always purchased at Shopko in Salem, Or. It was prescribed by Dr. Hook in Salem. So, I am not sure if I qualify for amnything or not.Thanks, henry wojciechowski
