Santander agreed to a $14 million class action lawsuit settlement to resolve claims it sent insufficient repossession notices to Pennsylvania borrowers. 

The settlement benefits borrowers who entered into a retail installment sales contract with Santander Consumer USA for financing the purchase of a motor vehicle, and whose vehicles were repossessed by Santander after the lender sent a notice of repossession to a Pennsylvania address between June 30, 2014, and July 9, 2020.

According to the class action lawsuit, Santander failed to send the proper repossession notices to Pennsylvania borrowers before repossessing their vehicles. Plaintiffs in the case claim the insufficient notices violated the Pennsylvania Uniform Commercial Code and the Pennsylvania Motor Vehicle Sales Finance Act.

Santander is a lender for consumers, small businesses and communities.

Santander hasn’t admitted any wrongdoing but agreed to a $14 million settlement to resolve the repossession class action lawsuit.

Under the terms of the Santander settlement, class members can receive a cash payment based on their account information. If additional funds remain in the settlement, up to three additional rounds of payments will be issued.

No payment estimates are available at this time. 

The deadline for exclusion and objection is Sept. 22, 2023.

The final approval hearing for the settlement is scheduled for Oct. 17, 2023.

No claim form is required to benefit from the settlement. Class members who do not exclude themselves will automatically receive a settlement payment.

    Purchased the car at a Kia Dealership, in Sept 2019. I was 62 at that time. I have never in my lifetime been required, to insure a vehicle, before I even saw it. The physical paperwork I have lists the Kia Dealership as the lender. Santander isn’t on any of the paperwork. COVID hit in March 2020 and everyone’s jobs changed dramatically. Payments were late and Santander demanded at least $ 2,000 almost all the time. Fast forward to May 2023. I got sick and was forced to retire, because of health issues. No income coming in, at all. Was 67 by that time. In May 2024, payments were behind and Santander wouldn’t accept payment, unless it was, of course $ 2,000. Car went up for repossession on July 17, 2024. The car is still in my possession and is parked in a Garage. Over 4 1/2 years of payments and owe more on the car, than at the time of purchasing it. Santanders predatory lending and their hostile business practices, has caused so much stress. In their agreement of the 2020 class action suit. They agreed to test their current loans, for customers with negative income. I have more than paid for that car and want the title. Thank you!

    I purchased a car through Santander and my car was replied. I was pushed into buying car over my financial payments. I was harassed at work and threatened. When repossed then I get harassed till this day and it was repoes in 209

      My husband bought a f150 from santander consumer in 2021, he really didn’t want to trade her was talked into it and told his payments would hardly go up, we don’t make a lot of money and his payments were 980 per month, lately we have fallen behind way behind and we have called to try and work something out so we don’t lose it but they refuse to try to work with us, now they are showing up all hours of the night trying to reposess it and we have to have something to drive to get to work what do we do? Do we qualify?

    The contract I have and the contract they have are completely different I owe them nothing they repo it one time I went into financial debt to get it out I am on the verge of getting evicted due to this matter they very rude they liars and now they took it again in back of my moms private property I need help I been on the internet looking a reporter reached out and told me this is illegal what Santander is doing but I never heard from him again can someone please hope me I gave them like 30,000 dollars .I never been through this I don’t know what to do

        During Covid, I put a couple payments at the end of my loan. I don’t have a problem paying those payments but now they’re trying to get me for another 22 of payment just for putting those ones on the end of my loan and charging me daily I don’t understand they want me to do a new contract for 22 months tell me I didn’t pay enough. They were charging me $400 a month for putting a payment at the end of my loan on top of the payment so 11 payments ended up being 22 payments. My payoff was supposed to be 2024 March they added 11 payments that I put at the end of my loan which changed my date to February 2025 now they’re saying even though the payments I’ve been making regularly I have not paid enough and I still owe two more payments after I’ve already paid 84 payments on my car they want $13,000 extra for putting 11 payments at the end of my loan that I’ve already paid for they told me they were charging me for interest per day and I still owe 8200+ interest which brings it up to 13,000. I don’t understand .

    My car was repo just I received no paperwork from them regarding the repo when I asked why I hadn’t received any notification . When I call to make arrangements to get my car was I couldn’t had pay it in full.
