Sagent Lending recently agreed to pay $1.75 million to resolve class action claims that they violated federal law by placing unsolicited phone calls.
The settlement will benefit individuals who received a prerecorded and/or automated call from Sagent, initiated by the company’s Noble version 8.02 telephony system, between July 1, 2014 and March 19, 2019.
Plaintiff Francis Woodrow filed his class action lawsuit against Sagent Lending in July 2018, claiming that the company violated federal law by making unsolicited, automated calls to consumers without their consent.
Woodrow reportedly received 15 phone calls from Sagent Lending in August and September of 2017, despite never having consented to these calls.
Each of the calls allegedly contained a prerecorded message that stated: “We have important information to speak to you about. Please call us between regular business hours…”
Woodrow claimed that these calls and prerecorded messages were a violation of the Telephone Consumer Protection Act (TCPA).The TCPA is a federal law that protects consumers from harassing phone calls, text messages, and faxes.
Sagent does not admit any wrongdoing by settling the class action lawsuit against them. Instead, the $1.75 million settlement allows for a peaceful resolution of the allegations without needing further litigation in court.
The exact payment amount each Class Member can collect will depend on the number of valid claims filed as well as the fees, costs, service awards, and settlement administration expenses deducted from the settlement fund. Many of these amounts will be determined at the settlement’s final approval hearing.
In order to receive payment from the TCPA settlement, Class Members need to file a valid claim by July 29, 2019. The deadline for exclusion and objection is July 29, 2019. The final approval hearing is scheduled for Sept. 19, 2019.
Who’s Eligible
Individuals who received a prerecorded and/or automated call from Sagent, initiated by the company’s Noble version 8.02 telephony system, between July 1, 2014 and March 19, 2019.
Potential Award
The $1.75 million class action settlement will be divided equally with all Class Members who filed a valid claim. The exact payment amount will depend on the number of valid claims filed as well as the fees, costs, service awards, and settlement administration expenses deducted from the settlement fund.
