Real Good Foods TCPA $1.25M class action settlement

A $1.25 million Real Good Foods settlement provides payments for consumers who received unsolicited spam texts about the frozen meal company’s products.

The settlement benefits consumers who received an unsolicited spam text from Real Good Foods regarding its goods or services after April 5, 2024, and who received texts after opting out of future messages.

Plaintiffs in the class action lawsuit claim Real Good Foods continued to send them unsolicited spam text messages even after they attempted to opt out of these texts. According to the telemarketing class action lawsuit, these texts violated the federal Telephone Consumer Protection Act.

Real Good Foods is a low-carb frozen food company sold at Costco, Walmart, Target and other retailers.

Real Good Foods hasn’t admitted any wrongdoing but agreed to pay more than $1.25 million to resolve the TCPA class action lawsuit.

Under the terms of the Real Good Foods settlement, class members can receive either a cash payment or a voucher for use on Real Good Foods products. Cash payments are capped at $8.25 per class member, but consumers can instead choose to receive $25 vouchers. Actual payments may be reduced on a pro rata basis depending on the number of valid claims filed.

The deadline for exclusion and objection is June 25, 2024.

The final approval hearing for the settlement is scheduled for July 15, 2024.

To receive Real Good Foods settlement payments, class members must submit a valid claim form by July 30, 2024.
