PMK*BNC Unpaid Internship Class Action Settlement

Unpaid interns for the PMK*BMC entertainment and public relations firm can claim benefits under terms of a current unpaid wages class action settlement.

Defendant PMK*BNC provides talent representation for the entertainment industry, as well as branding and public relations services for a broader range of different industries. Plaintiffs Alexandr Vainer and Joscelyn Corporan brought this unpaid wages class action lawsuit last year, claiming that PMK*BNC violated applicable laws by classifying certain unpaid interns as non-employees and failing to pay them wages.

By failing to pay its interns, the plaintiffs alleged, PMK*BNC violated the federal Fair Labor Standards Act, New York Labor Law, the California Labor Code, and the California Unfair Competition Law.

Under terms of the PMK*BNC settlement, the company will put up a settlement fund totaling $240,000. This fund will be distributed on a pro rata basis among qualifying Class Members who submit valid and timely claims, after deductions have been made for court costs, class counsel’s fees, and incentive awards for the class representatives.

The unpaid wages class action settlement does not require PMK*BNC to admit any fault, and the court has made no decision as to liability. The defendant continues to deny the plaintiffs’ claims.

Who’s Eligible

The settlement offers benefits for three different Classes of claimants:

• The FLSA Settlement Collective covers all persons who had an internship with PMK*BNC in California or New York between April 1, 2012 and Sept. 1, 2013.
• The California Settlement Class covers all persons who had an internship with PMK*BNC in California or New York between April 1, 2011 and Sept. 1, 2013.
• The New York Settlement Class covers all persons who had an internship with PMK*BNC in New York State between April 1, 2009 and Sept. 1, 2013.

Members of any of these settlement Classes are eligible to submit a claim. Some persons’ membership will overlap more than one Class. Each Class Member will receive no more than one payment for each internship.

Potential Award

Qualifying Class Members can receive a pro rata share of the settlement fund. Each Class Member’s payment will be determined in part by the number of internships worked, whether their internships were in California or New York, and whether their internships were during the summer or during the school year.

The maximum payments for each type of qualifying internship are:

• Summer internship in California: $750
• Summer internship in New York: $687
• Non-summer internship in California: $600
• Non-summer internship in New York: $550

Proof of Purchase

In addition to the Claim Form, Class Members must submit a copy of a government-issued identification.

Unverified Class Members must also submit proof of their internships. Such proof could include an offer letter, photograph, or some sort of correspondence referring to the internship.
