NoTax4Nash and other defendants in a class action lawsuit agreed to pay over $1 million to resolve claims that they placed unsolicited telemarketing calls.

The settlement covers a nationwide class of consumers who received one or more pre-recorded phone calls from NoTax4Nash (615-348-5237) to their cellphone July 16 or 17, 2020.

NoTax4Nash is a Nashville movement aimed at protesting a 34% property tax increase passed by the metro council in 2020. The group hoped to oust Mayor John Cooper in protest of the tax hike. In 2021, Cooper announced the tax rate would be pushed back down to its previous rate after the repeated crises in 2020, Fox 17 reported. 

According to a class action lawsuit against the group, NoTax4Nash violated federal laws by soliciting participation in the movement. In July 2020, thousands of Nashville residents allegedly received an automated phone call encouraging them to sign the petition against Cooper. The call said it was paid for by NoTax4Nash, according to plaintiffs in the case.

The robocall class action lawsuit claims NoTax4Nash violated the federal Telephone Consumer Protection Act (TCPA) by calling consumers without consent. Under the TCPA, businesses are required to get prior express written consent before contacting consumers with robocalls, spam texts or automated faxes. Because NoTax4Nash allegedly violated these rules, plaintiffs in the TCPA class action lawsuit sought thousands of dollars per violation as allowed under the law.

The defendants haven’t admitted any wrongdoing but agreed to pay $1,010,050 to resolve the class action lawsuit claims.

Under the terms of the settlement, class members can collect a cash payment. 

Class attorneys told Nashville News Channel 5 payments could be as low as $10 or as high as $80, depending on how many consumers participate in the settlement. Higher participation will result in lower individual payments. 

Regardless of the payment amounts, attorneys connected to the case told the Tennessean the settlement provides “substantial monetary relief and ensures that Nashville voters are not bothered by these kinds of robocalls again.”

Any leftover funds from the settlement resulting from uncashed checks will be paid to an unspecified charity. No funds will revert to the defendants in the case.

The deadline for exclusion and objection in the NoTax4Nash settlement is Aug. 8, 2022. 

The final approval hearing for the deal is scheduled for Sept. 15, 2022.

In order to receive a share of the NoTax4Nash settlement fund, class members must submit a valid claim form by Aug. 23, 2022.
