Neutrogena, Aveeno sunscreen carcinogens $1.75M class action lawsuit settlement

Johnson & Johnson has agreed to provide $1.75 million in vouchers as part of a class action lawsuit settlement to resolve claims Neutrogena and Aveeno sunscreen products were contaminated with carcinogens. Class members may submit a claim in the sun product settlement without proof of purchase.

The settlement benefits consumers who purchased certain Neutrogena and Aveeno products between May 26, 2015, and April 8, 2022. Products covered by the settlement are:

• Neutrogena Cool Dry Sport Aerosol Sunscreen
• Neutrogena Invisible Daily Defense Aerosol Sunscreen
• Neutrogena Ultra Sheer Aerosol Sunscreen
• Aveeno Protect + Refresh Aerosol Sunscreen
• Neutrogena Ultra Sheer Dry-Touch Water Resistant Sunscreen Lotion
• Neutrogena Sheer Zinc Dry-Touch Face Sunscreen Lotion
• Aveeno Baby Continuous Protection Sensitive Skin Sunscreen Lotion

Johnson & Johnson is a massive consumer product company that owns numerous personal care brands including Neutrogena and Aveeno. Both brands offer sunscreen products though these products may not be safe for use, according to the company website. 

In July 2021, Johnson & Johnson recalled certain Neutrogena and Aveeno sunscreens after third-party testing revealed the presence of benzene. Benzene is a known human carcinogen associated with leukemia, lymphoma, and other blood-related cancers. Shortly after Johnson & Johnson recalled these products, consumers took legal action against the company.

According to consolidated class action lawsuits against Johnson & Johnson, consumers had no idea they were exposing themselves to a known carcinogen by purchasing and using Neutrogena and Aveeno sunscreens. Although Johnson & Johnson offered a refund program after the recall, plaintiffs in several class action lawsuits argue the company should be held legally liable for selling contaminated products.

Johnson & Johnson hasn’t admitted any wrongdoing but agreed to resolve the sunscreen multidistrict litigation with a class action settlement.

Neutrogena, Aveeno sunscreen carcinogens class action lawsuit benefits

Under the terms of the sunscreen carcinogens settlement, class members can receive product vouchers based on the number of products they purchased. Each voucher is worth $10.58, and each household can claim up to two purchased products for a maximum payment of $21.16. Vouchers are transferable and will be valid for at least 12 months.

If a large number of claims are filed and the total claimed voucher value exceeds $1.75 million, voucher amounts may be decreased on a proportional basis.

The sun product settlement also includes non-monetary relief. 

Johnson & Johnson agreed to test its raw materials for benzene contamination to avoid further contamination of consumer-end products. Testing will be completed by a third party, according to the settlement agreement.

The deadline for exclusion and objection is July 7, 2022. 

The final approval hearing for the Neutrogena and Aveeno sun product lawsuit settlement is scheduled for Aug. 12, 2022.

In order to receive benefits from the sunscreen carcinogens settlement, class members must submit a valid claim form by July 7, 2022.

Product vouchers worth up to $21.16.

Each voucher is worth $10.58, and each household can claim up to two purchased products for a maximum payment of $21.16.
