Nationstar agreed to a $5 million litigation settlement to resolve a class action lawsuit claiming the company sent incorrect automated clearing house, or ACH, entries to mortgage borrower bank accounts in April 2021.

The settlement benefits consumers whose mortgages were or are serviced by Nationstar and who were affected by the incorrect ACH debit and credit entries sent April 23, 2021.

In April 2021, mortgage borrowers with loans serviced by Nationstar allegedly experienced incorrect ACH debit and credit entries on their bank accounts. These inaccurate entries allegedly caused consumers to overpay on their mortgages and sustain other financial damages.

Nationstar, now known as Mr. Cooper, is a mortgage lender and servicer. ACI, another defendant in the case, is an ACH clearing company.

Nationstar and ACI haven’t admitted any wrongdoing but agreed to a $5 million mortgage borrower class action lawsuit settlement to resolve the ACH claims.

Under the terms of the ACH settlement, class members can receive a cash payment. The settlement guarantees payments of at least $100 for all class members but allows claimants to seek additional compensation for unreimbursed out-of-pocket expenses they sustained as a result of the ACH incident.

Class members whose overpayment was already reimbursed may have their payments reduced. The $100 payments may also be reduced depending on the number of approved claims.

In addition to providing cash payments, Nationstar and ACI agreed to forgive any entitlement they may have to recover from class members. This includes $2.86 million in overpayments and around $190,000 in damages.

ACI agreed to implement several business practices to prevent future ACH incidents. These changes are valued at $1 million.

The deadline for exclusion and objection is April 29, 2023.

The final approval hearing for the Nationstar mortgage borrower ACH settlement is scheduled for May 31, 2023.

In order to receive settlement benefits, class members must submit a valid claim form by Nov. 13, 2023.

    We had Nation Star then Mr. Cooper. there were 3 times within the past 4 yrs they took out a second payment but put it back. i don’t know if we are eligible.

    I had Rushmore for years and never had problems with them. Since MRCOOPER bought Rushmore. I was charged 395$ more AUTOMATICALLY on Dec 2022 upuntil may where they AUTOMATICALLY raised the bill nearly 100$ more

    I don’t know if I’m eligible to partake in this class action lawsuit but if I am please let me know!

    This company bought our loan from Rushmore in Dec.2022. We had been with Rushmore nearly two years, they were fabulous. Never an issue with them. Mr. Cooper…..It has been nothing but a nightmare with them. The first month January after signing auto draft contract they took out (3) payments for January. Had my mother’s SSI not gone into my account it would have over drafted. They did refund (2) of those payments. Come Feb. our payment is due on the 1st, on the 13th, I receive a message saying the payment is late. They did not auto draft! I told them not to touch my account and de-authorized auto pay. I did send a check, with late fees on the 15th. I paid again on the 26th for March. March 20th for April, April 19th for May and May 28th for June. The payment was taken out of my bank and I do have the evidence of that. First they said it wasn’t received. Then, it was rejected (they couldn’t find my account} I sent them a photo of the check with the account number clearly written in the memo and then all of a sudden it was accepted as a regular payment but not for June, still pending and still late. The payment still isn’t credited to the account. My wife called on Tues. they told her we were in DEFAULT even though the payment isn’t late nor not made. They can’t decide if it was accepted or rejected. Either way it was taken out of my account, not updated to the account and they do NOT have proof from anywhere that the monies was put back in the account. I’m at my wits end with these people. I have contacted KY AG in hopes of getting something done. I can’t play games with these folks about our families home. PLEASE HELP!!!

    Mr. Cooper/Nation Star just sold our mortgage to Rush More Loan Mortgage Services. I am not sure if I qualify or not for the lawsuit/claims. We had a few late payments and had a loan modification done while with that company. Please contact me if I do qualify.
