A settlement has been reached over allegations that loans issued by Western Sky Financial LLC and held by CashCall Inc. to residents of Minnesota violated certain state laws.

If you took out loans from Western Sky that were held by CashCall and you lived in Minnesota at the time, you may be eligible for benefits from the payday loan settlement.

Under the terms of the payday loan settlement, eligible borrowers will receive cancellation of their Western Sky loans held by CashCall. They are no longer required to make payments on any loans that are covered by this payday loan settlement.

If you are a Minnesota borrower who took out Western Sky loans that were sold by CashCall to an unaffiliated buyer, and you were contacted about any of these loans since Sept. 1, 2016, you should contact the Minnesota Attorney General’s Office.

Minnesota borrowers will also be entitled to a credit history adjustment to remove any negative reports made by CashCall about Western Sky loans. Some borrowers will also be entitled to receive a cash payment from a $4.5 million restitution fund.

If you received a notice in the mail, you are eligible for a monetary payment under the CashCall settlement.

If you have relocated since you took out a CashCall loan, you should contact the Settlement Administrator to update your mailing address.

According to the settlement website, borrowers who submit timely and valid Claim Forms should receive their payments around March 2017.

Who’s Eligible

If you took out loans from Western Sky that were held by CashCall, and you lived in Minnesota at the time, you are eligible for benefits from this payday loan settlement.

Potential Award

Under the terms of the settlement, CashCall has agreed to:

  • Cancel outstanding Western Sky loans held by CashCall
  • Notify third parties who purchased Western Sky loans from CashCall that the loans should be cancelled
  • Tell credit reporting agencies to remove any reports made by CashCall about Western Sky loans.

If CashCall’s records show that it collected more in payments from you on an eligible loan than is permitted under Minnesota law, then you are eligible to receive a restitution payment from the CashCall settlement.
