A class action settlement was reached between Midland Funding, LLC and Midland Credit Management, Inc. with Class Members in Pennsylvania to resolve allegations that Midland sent “false, deceptive, and misleading” debt collection letters to consumers about a debt they allegedly owed to Verizon Pennsylvania. If you received a collection letter from Midland and live in the Commonwealth of Pennsylvania, you might qualify to benefit from this class action settlement.
The Midland class action lawsuit was filed by plaintiff Violet Bandina, alleging that Midland violated the Fair Debt Collection Practices Act (FDCPA) when it sent letters saying that the debt collector would stop applying interest to her debt if Blandina paid a reduced amount to cover her alleged debt. However, Midland wasn’t applying any interest to the debt, the class action lawsuit explained.
This Midland class action settlement is for anyone in Pennsylvania who received a collection letter from Midland Funding or Midland Credit Management after March 5, 2012 until Sept. 23, 2015 that included the following language: “Benefits of Paying! We will stop applying interest to your account!”
Midland agreed to pay $350,000 to settle the allegations in this FDCPA class action lawsuit, which will be divided among the Class Members.
Midland Funding and Midland Credit Management does not admit to any wrongdoing but has agreed to the terms of this class action settlement to avoid the cost and risk of going to trial. This Midland class action settlement was granted preliminary approval on Oct. 28, 2015 by U.S. District Judge Nitza I. Quinones Alejandro.
