Mercedes C-Class vehicle with HVAC issue

A class action settlement has been reached to resolve a Mercedes HVAC lawsuit claiming that the company’s vehicles can build up mold and mildew in its HVAC systems.

The settlement benefits current or former owners or lessees of the following Mercedes-Benz models: 2008 to 2019 C-Class vehicles; 2010 to 2015 GLK-Class vehicles; 2012 to 2017 CLS-Class vehicles; 2010 to 2019 E-Class vehicles; 2015 to 2019 GLA-Class vehicles; 2013 to 2016 GL-Class vehicles; 2016 to 2019 GLE-Class vehicles; 2017 to 2019 GLS-Class vehicles; 2012 to 2015 M-Class vehicles; or 2016 to 2019 GLC-Class vehicles.

A VIN lookup is available for consumers to check if their vehicle is eligible for the settlement.

Plaintiffs in the Mercedes HVAC lawsuit claimed that their vehicles were defective. Specifically, the owners and lessees alleged that these systems were defective and prone to developing mildew and mold.

“The mold-carrying air has a foul, mildewy smell that is highly unpleasant and can cause respiratory problems and aggravate allergies,” the Mercedes HVAC lawsuit alleged.

According to the plaintiffs, Mercedes-Benz was aware of the issue but failed to resolve the problem. Although the company offered cleanings of the HVAC system and replacements for cabin air filters, the Mercedes HVAC lawsuit argued that these remedies were only temporary.

Mercedes has not admitted to any wrongdoing but has agreed to resolve the claims against them, according to a Mercedes-Benz class action settlement website.

Under the settlement, Class Members can collect between 50 and 100 percent reimbursement for HVAC repairs related to the mildew issue. The amount of reimbursement a Class Member can collect depends on the age and mileage of their vehicles. More information is available in the “Potential Award” section below.

In order to benefit from the settlement, Class Members must submit a valid claim form through the Mercedes-Benz class action settlement website. Documentation of repairs is required to submit a claim.

The deadline for submitting a claim depends on the date of eligible repairs. For repairs completed before May 11, 2020, the claim deadline is July 25, 2020. For repairs completed between May 11, 2020 and Dec. 7, 2020, claims must be submitted within 75 days of repair completion.

The deadline for exclusion and objection is July 25, 2020. The final approval hearing for the settlement is scheduled for Sept. 9, 2020.

Who’s Eligible

Current or former owners or lessees of one of the following Mercedes-Benz models:

    • 2008 to 2019 C-Class vehicles;
    • 2010 to 2015 GLK-Class vehicles;
    • 2012 to 2017 CLS-Class vehicles;
    • 2010 to 2019 E-Class vehicles;
    • 2015 to 2019 GLA-Class vehicles;
    • 2013 to 2016 GL-Class vehicles;
    • 2016 to 2019 GLE-Class vehicles;
    • 2017 to 2019 GLS-Class vehicles;
    • 2012 to 2015 M-Class vehicles; or
    • 2016 to 2019 GLC-Class vehicles.

Potential Award

Reimbursement for HVAC repairs up to $900.

The coverage amount depends on the age and mileage of the vehicle, as follows:

  • Warranty Coverage Period (the earlier of 4 years from in-service date or 50,000 miles, under standard warranty): 100 percent reimbursement
  • From end of Warranty Coverage Period to the earlier of 8 years from in-service date or 100,000 miles: 70 percent reimbursement
  • From end of prior Period to the earlier of 10 years from in-service date or 125,000 miles: 50 percent reimbursement

Reimbursement for a single past repair performed by an independent service provider will be capped at $300. If there were multiple past repairs done by an independent service provider, total reimbursement is capped at $900. The same limitations do not apply to repairs done by an authorized Mercedes-Benz service center.

Future repairs are only covered if they are done by an authorized service center.

Proof of Purchase

Documentation of repairs and payment of repairs along with proof that the Class Member owned or leased the vehicle at the time of repairs.
