A $21 million class action settlement will resolve claims that a Massachusetts car dealership failed to pay overtime and premium pay.
The settlement benefits salespeople who were employed at a Herbert G. Chambers owned dealership in Massachusetts between Sept. 23, 2012 and May 8, 2019 and worked more than 40 hours in at least one week requiring overtime pay or worked a Sunday or holiday requiring premium pay.
Also included in the settlement are Client Care Specialists who were employed at a Herbert G. Chambers owned dealership in Massachusetts between March 15, 2013 and May 8, 2019 who worked more than 40 hours in at least one week requiring overtime pay or worked a Sunday or holiday requiring premium pay.
Plaintiffs filed several lawsuits against dealerships owned by Herbert G. Chambers in Massachusetts. According to the plaintiffs, employees of these dealerships were denied the overtime pay and holiday pay they were owed under state and federal law.
The dealership class actions claimed that the failure to pay wages was a violation of the federal Fair Labor Standards Act (FLSA.) The FLSA requires that employees be paid overtime wages at least one and a half times their regular rate of pay for all hours worked over 40 hours in a single workweek.
The law also sets out guidelines for other labor issues such as minimum wage, hours worked, record keeping, child labor, and more.
The dealerships have not admitted any wrongdoing but has agreed to resolve the claims against them for $25 million.
Under the settlement, Class Members will be able to collect cash payments depending on a claimant’s length of employment. Average payments are estimated to be $4,416.56. Individual amounts will vary.
In order to benefit from the settlement, Class Members need to file a valid claim form by March 30, 2020. The deadline for objection is also March 30, 2020. The final approval hearing for the settlement is scheduled for May 6, 2020.

Cash payments depend on a claimant’s length of employment. Average payments will reportedly be $4,416.56 although individual amounts will vary.

Current Status (Updated 5/12/20):
The final settlement approval hearing was held on May 6, 2020 and the settlement was approved on May 12, 2020. The settlement administrator will be working on preparing and sending settlement checks, which should go out by regular mail within about two weeks. You can still file a claim by clicking on the “Claim” button in the upper right-hand corner of this website and providing the requested information, but later filed claims will be paid during the second round of distributions in about two months.
