Lyons Magnus has agreed to a $3.5 million settlement to resolve a class action lawsuit claiming it failed to disclose suspected bacterial contamination in some of its specialty drink products, and no proof of purchase is required for consumers to benefit.
The class includes anyone who purchased a covered product for personal, family or household use, and not for resale, in the United States between April 1, 2021, and Oct. 27, 2022. A list of covered products is available on the settlement website.
Lyons Magnus offers a range of fruit, beverage and cocoa-based products, such as syrups, beverages and frozen desserts.
The company denies all allegations of wrongdoing but has agreed to the settlement to resolve the claims.
Under the settlement terms, class members who submit a valid claim with proof of purchase are eligible to receive the full purchase price for each unit of covered product on the proof of purchase, including taxes.
Those who submit a valid claim with no proof of purchase are eligible to receive up to the average retail price for up to two covered products per household, plus a 10% allowance for sales tax as determined by the defendant.
Payments may be increased or decreased pro rata based on the number of claims filed.
The deadline to opt out of or object to the Lyons Magnus class action lawsuit settlement is Feb. 9, 2024.
A final approval hearing is scheduled to take place April 9, 2024.

Who’s Eligible
Anyone who purchased a covered product for personal, family or household use, and not for resale, in the United States between April 1, 2021, and Oct. 27, 2022.

Proof of Purchase
An itemized retail sales receipt or other document that shows, at a minimum, the purchase of a covered product, the purchase price, and the date and place of purchase.
