Consumers who received unwanted telemarketing calls from hearing aid manufacturer ListenClear have secured a $1.2 million class action settlement.
If you got an unsolicited marketing call that utilized a robotic message on behalf of ListenClear between Aug. 1, 2016 and Dec. 31, 2018, you could get $20 from this class action settlement.
Plaintiff Matthew Hennie says he received 16 telemarketing phone calls from ListenClear in September and October of 2017. Hennie claims that he is not a customer of ListenClear and never provided his phone number to receive these calls.
Hennie alleges in the ListenClear telemarketing calls class action lawsuit that these phone calls are a clear violation of the Telephone Consumer Protection Act.
The TCPA was enacted as a federal law in the 1990s to stem the tide of annoying telemarketing behavior. The law imposes steep fines on entities that violate its prohibitions, including contacting consumers with marketing messages without their prior, express consent.
In addition, the TCPA limits the use of automatic dialing systems, prerecorded messages, and robocalls. The federal law also instituted the national “Do Not Call Registry” that allows consumers to include their phone number on the list if they do not wish to be contacted by advertisers.
The ListenClear telemarketing calls class action lawsuit alleged that the company used an artificial or prerecorded voice to contact consumers who had not provided express consent to the calls.
ListenClear contends that it has done nothing wrong, but agreed to pay $1.2 million to end the ListenClear telemarketing calls class action lawsuit.
Under the terms of the settlement, Class Members must submit a Claim Form either online or via mail. Class Members must provide either a claim number or the phone number that received the unwanted ListenClear telemarketing calls.
The deadline for Class Members to object to or opt out of the ListenClear telemarketing calls class action settlement is Sept. 4, 2019.
Who’s Eligible
Class Members include those who received a ListenClear telemarketing call, through ProspectsDM, between Aug. 1, 2016 and Dec. 31, 2018.

My husband received his settlement claim check and I lost it. I guess I picked it up with some junk mail and threw it in the trash. Is there anyway he can get a replacement check?
