Lamoille Health Partners agreed to pay $540,000 to resolve claims that it failed to prevent a 2022 Lamoille Health Partners data breach.
The settlement benefits individuals whose personal information was accessed or potentially compromised in the Lamoille Health Partners data breach in August 2022.
According to the class action lawsuit, Lamoille Health failed to protect patients from an August 2022 data breach that compromised their personal identifying information and protected health data. Plaintiffs in the case argue Lamoille could have prevented the breach by implementing reasonable cybersecurity measures.
Lamoille Health Partners is a health system that provides services to Lamoille County in Vermont.
The health system hasnโt admitted wrongdoing but agreed to a $540,000 settlement to resolve the Lamoille Health Partners data breach class action lawsuit.
Under the settlement terms, class members can receive an estimated pro rata payment of $50, as well as $5,000 for documented, unreimbursed out-of-pocket losses related to the data breach. Class members can claim losses such as credit expenses, bank fees, unauthorized charges, travel expenses and more.
The $50 pro rata payment will be distributed after attorneysโ fees, administration costs and other expenses have been deducted and other settlement benefits have been paid.
Benefits may be increased or reduced proportionately depending on the total amount claimed.
The deadline for exclusion and objection is May 20, 2024.
The final approval hearing for the Lamoille Health Partners data breach settlement is scheduled for Sept. 30, 2024.
To receive settlement benefits, class members must submit a valid claim form by June 20, 2024.
