LA Fitness International has reached a class action lawsuit settlement over claims it continued to charge New Jersey customers after they cancelled their gym memberships. If you entered into a Fitness Service Agreement with LA Fitness in the State of New Jersey during the time period February 28, 2006 through March 31, 2012, you can claim a number benefits from the class action settlement, including cash credits, refunds and free membership passes.
Who’s Eligible
Fitness Service Agreement Class
All individuals who entered into a Fitness Service Agreement with L.A. Fitness in the State of New Jersey during the time period February 28, 2006 through March 31, 2012.
Class Members in this group will receive either:
- Two free individual personal training sessions of 25 minutes each with a certified personal trainer (not a master trainer) at any New Jersey LA Fitness facility, except a Signature Club location; or
- A credit of $100 to be applied toward the purchase of a new Monthly Dues Membership at any LA Fitness facility (and can be used to offset any initiation fee and/or initial dues as applicable).
The deadline to request these benefits and/or use them is September 17, 2014.
To request these benefits, you must go to www.NJGymSettlement.com and enter the code that was provided to you in the Summary Notice that was either emailed or mailed to you. You will then be given instructions on how to sign up for the two free personal training sessions or a $100 credit for a New Monthly Dues Membership. You can also call the Settlement Administrator at 1-888-283-5570 to obtain your benefits. If you lost or misplaced your code you can obtain it at the Settlement Website or by calling the Settlement Administrator.
Membership Agreement Class
All Individuals who (a) entered into a Monthly Dues Membership Agreement in the State of New Jersey with L.A. Fitness, and (b) who paid for an additional month of dues (in addition to the application of pre-paid last month dues) after L.A. Fitness received a Notice of Cancellation during the Period of February 28, 2006 through March 31, 2012, and (c) the payment of an additional month of dues was not subsequently refunded.
Class Members in this group will receive a 45-Day Access Pass. They may also request a payment for monetary damages, which will equal 1/3 of one month of dues.
The deadline to request a cash payment is September 16, 2013. The 45-Day Access Pass must be activated by September 17, 2014 unless another date is set by the Court
To request your check for 1/3 or your monthly dues or to use the 45-Day Access Pass, you must go to www.NJGymSettlement.com and enter the code that was provided to you in the Summary Notice that was either emailed or mailed to you. You will then be given instructions on how to sign up for the 45-Day Access Pass. You will also be automatically set up to receive your check once the court enters a Judgment of final approval of the class action settlement. You can also call the Settlement Administrator at 1-888-283-5570 to obtain your benefits. Case Summary
The LA Fitness settlement will resolve a class action lawsuit (Martina v. LA Fitness International LLC) that accuses the fitness club chain of violating the New Jersey Consumer Fraud Act (CFA) by improperly collecting membership dues through the automatic renewal provisions of the club’s Membership Agreement. The plaintiff also alleges that the company’s Membership Agreement and Fitness Service Agreement violated the state’s Truth-in-Consumer Contract, Notice, and Warranty Act (TCCWNA) by including terms contrary to the CFA and the New Jersey Health Club Services Act (HCSA).
LA Fitness denies the allegations but has agreed to a class action lawsuit settlement to resolve the litigation. The settlement was preliminarily approved on May 29, 2013. It was granted Final Approval on October 8, 2013.

One thought on LA Fitness New Jersey Class Action Lawsuit Settlement
Members canceling their membership can get two personal sessions with a personal trainer or a $100 towards a monthly membership in the very facility they cancelled the membership from, or where they tried to cancel it from. LA Fitness makes it almost impossible to cancel your monthly membership. Google it.
