Korean Air Lines Co., Ltd. and Asiana Airlines Inc. have reached a $65 million class action lawsuit settlement resolving allegations they conspired to fix prices for air passenger travel between the U.S. and the Republic of Korea. If you bought a qualifying ticket between January 1, 2000 and August 1, 2007, you may be entitled to cash and coupons for future air passenger travel as part of the class action settlement.

The Korean Air settlement will resolve a class action lawsuit that claims the alleged conspiracy included meetings, conversations and communications in the U.S. and elsewhere between the two Defendants during which they agreed to establish artificially high prices for air passenger travel.

In cases separate from this class action lawsuit, brought by the United States Department of Justice, the Defendants pled guilty to criminal antitrust violations and agreed to pay a fine. Despite pleading guilty in the DOJ cases, Korean Air Lines and Asiana Airlines deny the allegations raised in the class action lawsuit but have agreed to a settlement to resolve the litigation.

The case is In Re: Korean Air Lines Co., Ltd., Antitrust Litigation, MDL No. 07-01891, U.S. District Court, Central District of California, Western Division.

UPDATE: On Feb. 8, 2016, a final hearing was scheduled and Judge Otero is expected to issue an order soon. Once the order is issued, the settlement funds and coupon codes will be distributed to Class Members who submitted a valid and timely Claim Form.

UPDATE 2: On Feb. 11, 2016, according to the settlement website, airline passengers who filed a claim in the Korean Air class action settlement should expect to receive a check and coupon code in April!
UPDATE 3: On April 21, 2016 the settlement website posted the following update: “We now expect that the distribution to claimants will occur in late May 2016.  Additional updates will appear on the website when the date for the distribution mailing is known. Thank you for your patience while the process is completed” Top Class Actions will continue to provide updates as we learn more. Second, PLEASE only submit claims you’re qualified for. Submitting false claims is not only illegal, it hurts the people who TRULY have a claim. Every false claim lowers the amount legitimate claimants can get, adds additional unneeded work to the settlement administrator, as they have to attempt to verify more claims (which delays payments for everyone), and it also makes settlement administrators much less likely to include internet notifications with groups like Top Class Actions as part of the advertising plan, which means YOU won’t hear about all of the settlements out there. False claims are a persistent problem and will result in less and less settlements getting listed on websites like Top Class Actions. Oh, and bragging about a false claim on social media is DUMB! Don’t you think settlement administrators are watching to see who’s dumb enough to comment or brag about doing something illegal? At a minimum those people will end up getting blacklisted and denied future claims, at a maximum you may start to see people get indicted for fraud. Remember, back in the 90s and early 2000s when we said, “They won’t ever go after anyone for downloading music illegally!” What happened? Many, MANY people got sued for thousands upon thousands of dollars and LOST.
Who’s Eligible

Class Members of the Korean Air settlement include anyone who purchased at least one ticket for air passenger travel on Asiana Airlines or Korean Air Lines. The purchase must have been:

  • Made in the United States;
  • For a flight originating in the U.S. and ending in Korean or a flight originating in Korea and ending in the U.S.; and
  • Made between January 1, 2000 and August 1, 2007.

Both businesses and individuals may be Class Members.

Potential Award

Class Members that submit a valid Claim Form will receive cash and coupons from the class action settlement, which will be distributed pro rata, based on the total number of qualifying purchases and valid Claim Forms submitted.

    Thanks for any information Eric, how did you cone up with that amout? One year ago Rust told me were all getting different amounts depends on how many trips, that’s why she couldn’t give me an amout at the time, it’s states that in paperwork, plus! I recorded the conversation I had with her

    final amounts will be $75.00 per claim(no matter how many trips you took) and $115.00 in future travel coupons.It has cost millions and millions in fees and lawyers etc.I guess we should be lucky we are getting anything!!!

    Do the math people! There’s a ton of money missing. Certificate Clearing.com $37 mlillion in coupons, now $26 million in coupons. This case started with $125 million not $65 mlillion read deeper. Settlement administrator’s are given to much power which some temptations ate hard to pass, I want break down 1: How much Rust paid (thieves) 2: How much for Phantom website 3: Why all the lies which were there undoing put them in spotlight when you think after being buster over the last decade on riff off report.com. Yes! I’m pissed also. So! No amount of money can change that, which were not getting much any ways Rust Stole. I’m entitled to tell the truth

        Per the clearing website. It mentions numbers. If you take the noted $27 mil in vouchers, divided by 87,000 class members. Thats about $300 per class member in coupons. About $500 in cash. Whats not clear is if that is 87,000 claims of flights where a claim is 1 flight or is it 87,000 class members with multi flights. ie 2 flights claimed would give you two $300 vouchers. Ill bet its per class member and one voucher.

          I told everyone there were never building a website *were that money they claimed they used to build website * All class action coupons go through Certificate Clearing.com who’s been in business over 20 years, remember technical difficulties all lies all lies. Pkease! People! Don’t be surprised June 27th or right after, they come up with another lue, cause they can’t use building website(they didn’t build one but we paid for it out of our money) They can’t use technical difficulties on website they didn’t build, I’m not that forgiving to a company horrible, deceitfulness , a little check just pissed me off, now I’m ready for what they owe me. Pay attention people more lies coming our way, don’t get excited you been told six lies and another coming, believe the bolony.

          You should also consider different types of tickets. Surely amounts for first, business and economy class tickets will be/should be different since their purchase prices are different. (Fisrt class = appx 4 X Econ and Business class = appx 2 X Econ) And we do not know how many claims are for what types of tickets. With that, the check amount we are all guesstimating can be far from the actual amount.

    This is the second class action I’ve been a part . The other was Burger King class action and Garden Group out state of Washington claim deadline September and check for $17,000 was in my hand in February. If I’m evet apart of another class action and the company picks Rust to distribute the funds I’m getting a private lawyer, you can do that. I’m done with Rust forever it’s not ok! What they done in the lat ten years with people’s money. Riff off report. Com
