Workers have managed to secure a class action settlement over allegations that Sunrise Senior Living Management Inc. violated the Illinois Biometric Information Privacy Act (BIPA) when it forced employees to use their fingerprints to clock in and out of work.

The Sunrise BIPA class action lawsuit alleged that employees had no way of knowing how long the company would keep copies of their fingerprints, leaving them exposed to identity theft and fraud in the event of a data breach.

According to the Sunrise employee class action lawsuit, Sunrise used the Kronos system to track timekeeping using employee fingerprints from Nov. 14, 2012 until Dec. 31, 2017.

Class Members in the Illinois Sunrise employee fingerprinting time clock class action settlement include those who worked for the company during that time and clocked in and out using the Kronos system.

Under the terms of the Sunrise employee fingerprinting class action settlement, Class Members could be eligible to receive either $25 or $75 depending on when they were employed with Sunrise.

Class Members will be opted into the Illinois Sunrise employee fingerprinting time clock class action settlement.

Those who do not wish to take part in the settlement must either object to the settlement or ask to be excluded from its terms no later than Jan. 18, 2019.

The final hearing is scheduled for Feb. 14, 2019.

Who’s Eligible

Class Members include “current or former employee of Sunrise who worked at a facility in the State of Illinois and used the Kronos time clock finger-scanning option between November 14, 2012 and December 31, 2017.”

Potential Award

$25 or $75 depending on dates of employment.

Proof of Purchase

None. Class Members will automatically receive a payment.

    When I went to John amicio beauty school I always had to use a finger scanner to punch in, out, and for meals and breaks. To top it off if I forgot to punch back in no one was able to fix my time and half the time I ended up working off the clock. They also lost my hours so I get to restart at another school from square one. I really hope they got rid of their mold problems. I only knew about that bc of my sensitive nose and my allergy to mold.

    I worked at a facility in CA where we had to scan our whole hand to clock in and out. Was that a violation too? I worked there for about 5 years.

    That was done here in Michigan, at a restaurant that let everyone go then change their name. They did not let anyone know about what would happen to our information and we had to use our last four digits of our SSN, to have asset to the back door. I have mention this before on Start a Class Action, no one have tried to contact me. All i would like to know if I and others have a case!!!!
