The Equal Opportunity Employment Commission (EEOC) secured a $750,000 settlement with Hyde club operators to resolve claims female employees and applicants were sexually harassed.

The settlement benefits female applicants to or employees of the Hyde Nightclub at the Bellagio in Las Vegas from Jan. 1, 2014, to July 6, 2019. The settlement also includes female applicants of employees of the Hyde Lounge at T-Mobile Arena between Jan. 7, 2016, and March 31, 2020. In order to benefit from the settlement, the individual must have been the victim of sexual harassment during their employment or application process.

The Hyde Nightclub and Hyde Lounge in Las Vegas offering food, drinks and music. The locations were in the Bellagio, a casino resort hotel, and T-Mobile Arena, a Las Vegas sports and concert venue; Hyde Nightclub at the Bellagio is now closed.

According to the EEOC, female applicants and employees of these clubs may be subject to sexual harassment and related retaliation. This treatment allegedly created a hostile work environment that violated Title VII of the Civil RIghts Act.

Defendants in the case agreed to pay the EEOC $1 million to resolve these allegations. $750,000 of this payment is now being used to fund a settlement.

“Applicants and employees are entitled to a workplace free from violations of federal employment laws,” EEOC Chair Charlotte A. Burrows said in a statement following the settlement being reached. 

“The EEOC remains steadfast in executing its mission to help employers comply with the law and remedy discrimination and harassment when warranted.”

The EEOC encourages female applicants and employees to apply if they think they may have been subject to sexual harassment and retaliation. If the EEOC deems claimants to be eligible for payment, they will receive a notice indicating their payment amount. Payment amounts will vary depending on the information given by claimants and the decision by the EEOC, which may reach out to claimants via phone or email for more information.

If the EEOC deems claimants ineligible, they will receive a notice of ineligibility with more information.

In addition to paying $1 million to resolve the claims, Hyde Bellagio operators agreed to make changes to its sexual harassment policies and hire an equal employment opportunity consultant to review policies, complaints and other procedures to ensure accountability and proper handling of workplace harassment.

There is no deadline for objection or exclusion.

No final approval hearing is scheduled for the settlement.

Those who are eligible to submit a valid claim form must do so by July 19, 2022.
