Health Aid of Ohio agreed to a class action lawsuit settlement to resolve claims it failed to protect consumer information in a data breach.
The settlement benefits individuals who were sent a notice informing them their personal information may have been compromised in a February 2021 data breach affecting Health Aid of Ohio.
Health Aid of Ohio is a home equipment provider that provides access to mobility aids and other equipment. In May 2021, the company revealed it was the victim of a data breach Feb. 19, 2021.
According to the Health Aid of Ohio data breach notice, a third party reportedly gained access to various files on Health Aid of Ohio’s systems. Although a subsequent investigation couldn’t pinpoint which files were affected, the notice says customer names, dates of birth, Social Security numbers, medical diagnoses, insurance information, telephone numbers and other information could have been taken in the breach. Consumers may have had their information compromised if they received services through a Veterans Affairs (VA) plan.
Some affected consumers took legal action against Health Aid of Ohio, arguing the company should have better protected their information with reasonable cybersecurity measures. The Health Aid of Ohio data breach class action lawsuit included claims of negligence, invasion of privacy, unjust enrichment and more.
Health Aid of Ohio hasn’t admitted any wrongdoing but agreed to resolve these allegations with a class action settlement.
Under the terms of the settlement, class members whose Social Security numbers were compromised can recover a payment based on their out-of-pocket losses, lost time and extraordinary losses.Â
Out-of-pocket expenses such as credit monitoring and fees can result in cash payments of up to $250, including up to four hours of lost time at a rate of $15 per hour. Extraordinary expenses resulting from fraud will be compensated in payments of up to $2,500 per class member.Â
In order to collect either of these payments, class members must provide documentation.
The settlement also provides all class members with one year of free credit monitoring and identity restoration services, even if their Social Security numbers were not stolen in the breach.
In addition to providing these settlement benefits, Health Aid of Ohio agreed to make cybersecurity enhancements to better protect customer information. The company will undergo security risk assessments in 2022 and 2023 to gauge where it needs to make changes.
The deadline for exclusion and objection is July 22, 2022.Â
The final approval hearing for the Health Aid of Ohio data breach settlement is scheduled for Sept. 20, 2022.
In order to receive a payment from the settlement, class members must submit a valid claim form by Aug. 22, 2022.
