Hardware Resources Junk Fax Class Action Settlement

An $11.75 million settlement has been reached in a class action lawsuit alleging Hardware Resources Inc. violated the Telephone Consumer Protection Act by sending unsolicited fax advertisements that do not comply with the TCPA’s requirements.

If you are a subscriber of a fax number to which there was a successful transmission of at least one fax by Hardware Resources between December 2012 and November 2015, you may be eligible for a cash payment from the TCPA class action settlement.

The Telephone Consumer Protection Act is a federal law that allows consumers to take legal action against the party responsible for sending unsolicited fax advertisements and fax advertisements that do not comply with the TCPA’s opt-out requirements.

Under the TCPA, consumers may recover statutory damages of $500 per violation, or up to $1,500 per violation if the sender willfully and/or knowingly violated the TCPA.

Plaintiff Craftwood Lumber Company filed the TCPA class action lawsuit against Hardware Resources on Sept. 6, 2016. Craftwood alleges it received a fax from Hardware Resources regarding changes in the prices of products sold by Hardware Resources on Dec. 12, 2012, and that similar faxes were sent to consumers on multiple occasions until November 2015.

Craftwood alleges Hardware Resources violated the provisions of the TCPA that prohibit the sending of unsolicited fax advertisements and advertisements that do not comply with the law’s opt-out provisions.

Hardware Resources denies that it violated the TCPA but agreed to settle the junk fax class action lawsuit to avoid the cost and uncertainty of litigation.

The Hardware Resources junk fax class action settlement was preliminarily approved on July 7, 2017.

Who’s Eligible

Class Members of the Hardware Resources TCPA settlement include all subscribers of fax numbers to which there was a successful transmission of one or more faxes by Hardware Resource in broadcasts by Profax Inc. on or about the following dates:

• Dec. 6, 2012
• Nov. 15, 2013
• Nov. 17, 2014
• Nov. 18, 2014
• Nov. 24, 2014
• Nov. 16, 2015

Potential Award

$230 per fax

Proof of Purchase

None required. The number of fax transmissions that were sent to your fax number will be determined from the defendant’s records.

NOTE: Class Members must provide a completed Form W-9 or valid Taxpayer Identification Number. If they fail to do so, their payment will be limited to $599.99 regardless of the number of faxes received.
