Congratulations to everyone who filed a claim and got paid!
Consumers nationwide whose information may have been accessed during a 2017 data breach may be eligible for compensation as part of a settlement in a Forever 21 class action lawsuit.
Any U.S. resident who used a credit, debit, or other payment card to make a point-of-sale purchase at an affected Forever 21 store while payment card data at the store was at risk is a Class Member.
A list of the Forever 21 stores affected by the 2017 data breach is available on the settlement website.
The plaintiffs in the Forever 21 data breach lawsuit claim the company was responsible for a security incident that took place between about April 13 and Oct. 24, 2017, and allege the company is guilty of breach of implied contract and violating California consumer protection laws.
Popular clothing and accessories company Forever 21 has more than 540 locations worldwide and offers online shopping.Â
Two types of payments are available to Class Members who file a claim:
- Expense Reimbursement: includes time spent — up to four hours and $25 — reimbursement of self-paid credit monitoring, and expense reimbursement of up to $250
- Extraordinary Expense Reimbursement: includes other extraordinary unreimbursed monetary losses incurred because information was compromised as part of the security incident, up to $10,000
Expense Reimbursement claims cover out-of-pocket expenses resulting from the breach, such as unreimbursed bank fees, long-distance phone charges, internet usage charges, and more, and up to $135 in costs incurred toward credit monitoring, identity theft insurance or similar products purchased by the Class Member between April 13, 2017, and July 1, 2019.
If fraudulent charges were incurred on a payment card, the Class Member may receive $25 in compensation for inconvenience associated with up to one hour of lost time, plus an additional $25 per hour for up to four hours of documented lost time.Â
If such charges did not occur, the Class Member may claim up to three hours of lost time at $25 per hour spent dealing with the security incident, but only if at least one full hour was spent.Â
To claim an Extraordinary Expense Reimbursement, the Class Member must show an actual, documented, unreimbursed monetary loss; must show that loss was more likely than not caused by the data breach; must show the loss was incurred between April 13, 2017, and March 21, 2022; must show that the loss was not already covered by one of the Expense Reimbursement categories; and must show a reasonable effort was made to either avoid the loss or seek reimbursement for the loss, including exhausting credit monitoring and identity theft insurance options.
A final hearing in the Forever 21 2017 data breach lawsuit settlement is set for April 21, 2022.
The deadline to opt out of or object to the Forever 21 class action lawsuit settlement is March 21, 2022.
The claim deadline is also March 21, 2022.

For one the claim date to join in this was March of 2022! You can’t just say add me ! On open ones you have to fill out a claim form! 🤣🤣🤣
Also it wasn’t a settlement cause you just bought something in March of 2022 it’s for the year 2017 haha
