Farfetch agreed to pay $4 million to resolve a class action lawsuit claiming it violated California law by recording phone calls without first obtaining caller consent.Â
The settlement benefits California residents who placed a phone call to Farfetch’s customer service telephone number (646-791-3768) between April 1, 2019, and Aug. 3, 2020, and were not informed their call may be recorded.Â
Plaintiffs in the class action lawsuit claim they were not warned their calls would be recorded when they placed phone calls to Farfetch’s customer service telephone number. This allegedly violated California’s call-recording law that requires all parties to a call to consent to record.Â
Farfetch is a website and mobile app that sells luxury clothing, accessories and beauty products. Farfetch shoppers may also enjoy products from Bebe.
Farfetch hasn’t admitted any wrongdoing but agreed to a $4 million settlement to resolve the call recording class action lawsuit.
Under the terms of the settlement, class members can receive a cash payment based on the number of qualifying calls they placed during the class period.Â
According to the settlement website, each class member is anticipated to receive around $125 per call. Actual payments may be higher or lower depending on the number of participating class members and the number of claimed calls.Â
Each class member will be assigned a number of calls based on the defendant’s records. Class members who wish to dispute this number may do so by submitting supporting evidence such as phone logs.Â
The deadline for exclusion and objection is June 11, 2023.
The final approval hearing for the settlement is scheduled for Aug. 11, 2023.
In order to receive settlement benefits, class members must submit a valid claim form by June 11, 2023.
