Acuity, formerly known as Comprehensive Health Services, agreed to a class action lawsuit settlement to resolve claims surrounding a 2022 data breach.

The settlement benefits individuals who received a data security incident notice from Acuity on or around Feb. 15, 2022.

According to the data breach class action lawsuit, Acuity failed to protect consumer information from unauthorized access. As a result, 106,910 individuals allegedly had their personal identifying information stolen by hackers. 

Acuity, which operates under the name Comprehensive Health Services, is a global solutions company that provides medical management support.

Comprehensive Health Services hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum as part of a settlement to resolve the data breach class action lawsuit.

Under the terms of the settlement, class members can receive up to $500 for out-of-pocket expenses including bank fees, credit expenses and three hours of lost time at a rate of $20 per hour. 

Class members who experienced identity theft as a result of the data breach can receive higher payments of up to $3,500 for documented expenses related to their identity theft. 

All class members, even those who did not experience identity theft or out-of-pocket expenses as a result of the data breach, can receive two years of free credit monitoring services under the settlement. 

The deadline for exclusion and objection is July 5, 2023.

The final approval hearing for the settlement is scheduled for Aug. 11, 2023.

In order to receive settlement benefits, class members must submit a valid claim form by Aug. 3, 2023.
