Chestnut Hill Hospital, LLC and Tower Health agreed to a class action lawsuit settlement to resolve claims they violated Philadelphia’s “Ban the Box” law by asking job applicants about their criminal history.

The Chestnut Hill Hospital settlement benefits individuals who applied for employment at Chestnut Hill Hospital in Philadelphia between Oct. 1, 2017, and Sept. 30, 2020, and whose online job application asked if they had been convicted of a felony or misdemeanor in the last seven years.

According to the class action lawsuit, Chestnut Hill Hospital and Tower Health violated the Philadelphia Fair Criminal Records Screening Standards Ordinance — also known as the “Ban the Box” law — by asking job applicants about their criminal history on initial job applications. The hospital allegedly violated the “Ban the Box” law by denying applicants employment based on their criminal histories before giving them a chance to prove their qualifications.

Chestnut Hill Hospital, now known as Temple Health, is a hospital in Philadelphia that is part of the Temple University Health System.

Chestnut Hill Hospital and Tower Health haven’t admitted any wrongdoing but agreed to pay an undisclosed sum to resolve these allegations.

Under the terms of the Chestnut Hill Hospital settlement, class members can receive a cash payment of $400.

The deadline for exclusion and objection was Dec. 6, 2024.

The final approval hearing for the Chestnut Hill Hospital class action lawsuit settlement is scheduled for Feb. 25, 2025.

In order to receive settlement benefits, class members must submit a valid claim form by Feb. 3, 2025.

Who’s Eligible

Individuals who applied for employment with Chestnut Hill Hospital LLC between Oct. 1, 2017, and Sept. 30, 2020, and whose employment application contained the question “Have you been convicted of a felony or misdemeanor in the last 7 years?” on an online job application.
