Ceridian HCM Inc. has agreed to a nearly $3.5 million settlement resolving a class action lawsuit alleging it collected employees’ fingerprint data in violation of the Illinois Biometric Information Privacy Act (BIPA).

Employees in Illinois who scanned their fingers on a Ceridian-branded timeclock between May 28, 2014, and May 17, 2022, may be entitled to compensation from the Ceridian class action settlement.

BIPA is an Illinois law that prohibits private companies from capturing, storing, obtaining and/or otherwise using individuals’ biometric data for any purpose without first providing notice and obtaining their written consent.

Biometric data includes iris scans, fingerprints, faceprints and other permanent biometric identifiers.

The BIPA class action lawsuit alleges Ceridian violated BIPA by allegedly collecting biometric data from employees when they used Ceridian’s finger-scan time clocks in Illinois without providing notice or obtaining consent.

When employees work for companies that use Ceridian’s time clocks, they are allegedly required to scan their fingerprints to clock in and clock out of work instead of using a key fob or ID cards.

The Ceridian class action lawsuit notes that there are significant risks associated with biometric clocks in the workplace. Unlike key fobs and ID cards, biometric data cannot be changed if it is compromised.

If a fingerprint database is compromised, employees are unable to protect themselves from identity theft and/or unauthorized tracking, the Ceridian class action lawsuit alleges.

Ceridian allegedly violated BIPA by failing to properly inform employees in writing about the purpose and length of time their fingerprint data would be collected and used, failing to provide a publicly available retention schedule for the biometric data, and failing to obtain a written release from employees to obtain and capture their fingerprint data.

Ceridian denies the allegations but agreed to settle the biometric data class action lawsuit to avoid the burden and expense of ongoing litigation.

Payments to eligible claimants are expected to range from $790 to $1,580, but the actual payments will depend on the total number of claims submitted.

Class members who wish to exclude themselves from or object to the Ceridian class action settlement must do so no later than Sept. 6, 2022.

A final approval hearing is scheduled for Oct. 3, 2022.

The deadline to submit a claim for the Ceridian BIPA class action settlement is Sept. 30, 2022.

If you did not receive a notice via mail, or if you can’t find your Notice, you may still submit a claim without a Class Member ID. You can also contact the Settlement Administrator for your Class Member ID before submitting your Claim.
