Celsius agreed to a $7.8 million class action lawsuit settlement to resolve claims it falsely marketed its beverages as containing “no preservatives.” No proof of purchase is needed for class members to benefit from the settlement.

The settlement benefits consumers who purchased any Celsius beverage (aka Celsius Live Fit), Celsius Heat, Celsius BCAA+Energy, Celsius with Stevia, Celsius On-The-Go powdered drinks and/or Flo Fusion powdered drinks between Jan. 1, 2015, and Nov. 23, 2022.

Celsius sells fitness drinks aimed at providing energy, increasing metabolism and burning body fat. The brand offers a number of varieties including drinks made with stevia and drinks with additional branched-chain amino acids, or BCAAs.

According to a class action lawsuit, Celsius falsely advertised its beverages as containing “no preservatives.” In reality, Celsius beverages allegedly contain citric acid — a flavoring agent and preservative. Plaintiffs in the false advertising class action lawsuit claim they wouldn’t have purchased Celcius drinks or paid as much for the products if they knew the truth.

“Defendant knows that consumers are willing to pay more for natural, healthy products, and advertises the Product with the intention that consumers rely on the representations that the Product has ‘No Preservatives’ and no artificial flavors,” the Celsius class action lawsuit claims.

The false advertising class action sought compensation for this false advertising and reimbursement for purchases of mislabeled Celsuis drinks.

Celsius hasn’t admitted any wrongdoing but agreed to a $7.8 million class action settlement to resolve these allegations. 

Under the terms of the Celsius settlement, class members can receive a cash payment based on the number of products they purchased. 

The settlement allocated payments of $1 for each can or $5 per package of 14 powdered drinks. Class members who can provide proof of purchase can receive up to $250 in reimbursement. Class members without proof of purchase can receive up to $20. 

Total payments may be adjusted based on the number of claims received. If a large number of claims are received, claims will be reduced on a pro rata basis. If a smaller number of claims are received than expected, claims will be adjusted upward to up to two times the claimed amount — up to $500 with proof of purchase or $40 without proof of purchase.

The deadline for exclusion and objection is Feb. 13, 2023. 

The final approval hearing for the Celsius settlement is scheduled for March 31, 2023.

In order to receive settlement benefits, class members must submit a valid claim form by Feb. 13, 2023.

Who’s Eligible

Consumers who purchased any Celsius beverage (aka Celsius Live Fit), Celsius Heat, Celsius BCAA+Energy, Celsius with Stevia, Celsius On-The-Go powdered drinks and/or Flo Fusion powdered drinks between Jan. 1, 2015, and Nov. 23, 2022.

    Update: On April 5, 2023, the Court entered a Final Order and Judgment approving the Settlement, awarding Attorneys’ Fees and Expenses, and Service Awards. No mention on payments yet.
