Capital One will pay $190 million as part of a customer data security litigation settlement to resolve claims it jeopardized customer information in a 2019 data breach. Consumers may file a Capital One settlement claim through Aug. 22, 2022.
The settlement benefits around 98 million Capital One customers whose information was compromised as part of the 2019 data breach.Â
Capital One offers a variety of financial services to customers. However, according to the bank, its customers were targeted in a 2019 data breach.
In July 2019, Capital One informed its customers that millions of them had their information compromised when a third party accessed bank systems. Although the perpetrator was captured by the Federal Bureau of Investigation (FBI), sensitive information such as names, birth dates, addresses, phone numbers, credit scores, contact information, credit balances, payment history, and even Social Security numbers were compromised.
Customers affected by the data breach swiftly took legal action against Capital One, arguing the bank violated its duties to protect consumer information.Â
According to the plaintiffs, their information would have been secured and protected if Capital One took reasonable cybersecurity measures. Their failure to protect consumer information directly put customers at risk for identity theft and fraud, the Capital One class action lawsuit contends.
Capital One hasn’t admitted any wrongdoing but agreed to pay $190 million to resolve the claims.
Under the terms of the settlement, class members can collect a cash payment for out-of-pocket expenses and lost time.Â
The settlement allows reimbursement for up to $25,000 in out-of-pocket expenses related to the data breach. This includes money spent preventing identity theft or fraud, unreimbursed fraud charges, miscellaneous expenses, professional fees, and up to 15 hours of lost time at a rate of at least $25 per hour. These payments require detailed documentation including bank statements, invoices, and receipts.Â
The settlement also provides three years of identity defense services through Pango. These services provide dark web monitoring, identity monitoring, lost wallet protection, security freeze capabilities, $1 million in insurance, and other benefits.Â
The settlement also provides free restoration services through Pango to support class members in the case of fraud or identity theft.
In addition to providing the benefits listed above, Capital One has committed to extensive cyber security practices for at least two years. These changes aim to better protect customer data.
The deadline for exclusion and objection is July 7, 2022.Â
The final approval hearing for the settlement is scheduled for Sept. 8, 2022, rescheduled from Aug. 19, 2022.Â
In order to receive a payment or other benefits from the Capital One data breach settlement, class members must submit a valid claim form by Sept. 30, 2022.

Received email like everyone else that I can claim my $700 today. Immediately went on and selected PayPal option and said money would be in account within 2 days. Was an easy process. EPIQ is a legit company and have used them many times before. Not a scam.
Not everyone is getting the same amount. I am receiving $565.85. I agree with some of the comments about how to receive the money. I also chose ACH deposit into my bank account. It is supposed to be in my account on October 10 by end of day… Seven business days. I don’t know how fast the other options are but if you’re in need of the funds sooner than 7 days, I’d go with another option.
How do you know how much you are receiving & how did you pick how to get your money? I received an email to fill out W9 + that I will get a check there was no option to pick anything. Nor did it tell me an amount.

If you received a request to fill out a W9, that means your award amount is a bit larger than the average award for other class members. I assume that’s why they may not want to pay out electronically but don’t quote me on that

Hello everyone!!! Question, Mayne someone could answer, I did receive an email months ago regarding the lawsuit about Identity protection filled that out and haven’t received an email as of yet? Lol

Is this legit epiq pay I am worried that it is fraud and it is weird that everyone got the same amount. Can an atty or someone from let us all know if this is legit.

I wonder if everyone that is getting $707.31 filled out the 5 hours at $25/hour without documentation needed? Is that the common denominator between us all?
Has anyone gotten the payment link or payment yet? Something just doesn’t seem right! How can so many people be receiving the same exact amount ($707.31) if every case is based on the particular loss of that individual!? As someone else said, this seems very fishy, something is not right. The administrators need to update the website with more accurate, clearer information.
707.31 is for the people who claimed 5 hours of spent time and no out of pocket losses. It’s a common claim as it’s the maximum you can put in without proof

Just fyi…if u select deposit to bank…ACH..it told me my bank account would not get for 2 to 4 business days…it told me by Friday October 6…I would not have done that way if I had known…
