Livingston International employee working overtime

Livingston International recently agreed to pay $19 million to resolve claims that they failed to pay their Canadian workers the overtime they were legally owed.

The settlement benefits current and former Canadian Livingston employees who worked for the company between Aug. 15, 2007 to April 28, 2017 as administrative, clerical, technical, and supervisory workers.

Plaintiff Michael Bozsik reportedly worked for Livingston International until November 2012. In his class action against the company, which was filed in October 2014, Bozsik claimed that he was routinely underpaid when it came to overtime compensation.

The company reportedly forced employees to work overtime hours in order to carry out their duties but encouraged them to not record these hours worked – meaning that administrative, clerical, technical, and supervisory workers were allegedly denied overtime wages.

These practices were reportedly reinforced by a company policy which required employees to secure advanced authorization to work overtime. If employees failed to do this, they would allegedly not be paid overtime wages. Unfortunately, the nature of the employees’ work reportedly made it near impossible to get advanced authorization, allegedly creating a “systematic barrier” which Livingston used to its advantage.

Livingston agreed to settle the overtime claims against them by paying $19 million. The company has not admitted any wrongdoing by settling the case against them but instead seeks to resolve the claims.

Under the settlement, each Class Member will be entitled to a proportional share of the net settlement fund based on their years of employment, wage rate, computer records, and calculation of overtime owed.

Class Members who currently work for Livingston are not required to file a Claim Form, their compensation will be automatically mailed to them. Former employees are required to complete a Claim Form in order to receive compensation. These forms need to be submitted by Oct. 15, 2019.

The settlement was granted approval in Canadian court on June 21, 2019.

Current and former Canadian Livingston employees who worked for the company between Aug. 15, 2007 to April 28, 2017 as administrative, clerical, technical, and supervisory workers.

Potential Award
