Canada Dry Ginger Ale ‘Real Ginger’ Class Action Settlement

Editor’s Note: A new class action lawsuit was filed on Oct. 29, 2024, against Keurig Dr Pepper Inc., alleging it falsely advertised its Schweppes and Canada Dry beverages as “naturally flavored” without disclosing they also contain artificial flavors. A $11.2 million settlement has been reached that would resolve class action claims that Canada Dry Ginger Ale doesn’t contain real ginger.

If you purchased Canada Dry Ginger Ale between Jan. 1, 2013 and Dec. 19, 2018 in any U.S. state (except California), you could get cash from this class action settlement.

California residents are also included in the Canada Dry Ginger Ale class action settlement as long as they purchased the beverage between Dec. 28, 2012 and June 26, 2018.

The Canada Dry Ginger Ale settlement resolves two class action lawsuits that challenge label claims that the soda is “Made from Real Ginger.”

According to the Canada Dry Ginger Ale class action lawsuits, Dr. Pepper Snapple Group includes chemical flavoring in the soft drink that imitates the flavoring of ginger but doesn’t provide the health benefits of consuming the actual root.

The Canada Dry Ginger Ale class action lawsuits claim that consumers paid a premium for this soft drink because ginger is known to provide health benefits such as stomach calming.

In reality, plaintiffs allege that the beverage is made with carbonated water, high fructose corn syrup, citric acid, preservatives, and chemical flavoring.

Under the Canada Dry Ginger Ale class action settlement, two tiers of compensation are available to Class Members who file a valid claim.

Tier 1 provides 40¢ per unit (can) for up to 13 units, i.e. up to $5.20 per household. Tier 2 provides the same 40¢ per unit but allows up to 100 units, or up to $40 per household. Compensation under Tier 2 requires proof of purchase.

In addition to the cash payout, the ginger ale class action settlement also requires Dr. Pepper to change product labels to include words such as “taste,” “extract,” or “flavor” if it continues to represent “ginger” as a ingredient.

Class Members who want to object to or wish to be excluded from the settlement must do so by March 19, 2019.

Who’s Eligible

Non-California consumers who purchased Canada Dry Ginger Ale between Jan. 1, 2013 and Dec. 19, 2018.

In addition, California residents who bought Canada Dry Ginger Ale between Dec. 28, 2012 and June 26, 2018.

Potential Award

Tier 1 claims can recover 40¢ per unit, up to $5.20 per household. Tier 2 claims can recover 40¢ per unit, up to $40 per household.

Proof of Purchase

Receipts are required for Tier 2 claims.
