NEW YORK TIMES SUBSCRIPTION SETTLEMENT UPDATE:

The New York Times Co. has agreed to a $5.563 million class action settlement benefiting certain consumers whose subscriptions to the newspaper renewed automatically.
The Class is defined as anyone who, from June 17, 2016, through May 12, 2021, enrolled in an automatically renewing New York Times subscription directly through The New York Times Co. using a California billing and/or delivery address, and who was charged and paid an automatic renewal fee or fees in connection with that subscription.
The lead plaintiff in a class action lawsuit claimed she had purchased a monthly New York Times subscription, but was surprised when that subscription renewed automatically and she was charged for additional months. Allegedly, the company’s failure to alert consumers about the auto-renew practice was a violation of California law.
The New York Times Co. denies the claims. A Court has not ruled in favor of either party.
As of May 5, 2021, The New York Times, founded in 1851, reported it had more than 7.8 million subscribers across their print and digital products.
The settlement fund consists of $1.65 million in cash and about $3.913 million in automatic access codes.
After the settlement is finalized, each Class Member will be eligible to receive and access code for free use of certain digital subscriptions to The New York Times or to submit a valid claim and receive a proportionate cash payment.
Class counsel estimates the payments will be about $5.
Those who do not submit a claim and do not exclude themselves from the settlement will receive the automatic access code. This code will allow for the free use of certain digital New York Times subscriptions that would normally require a paid subscription.
There will be no obligation to continue using the service beyond the free period.
Class Members who have an active New York Times subscription and do not take action will receive a code for a free one-month digital product subscription (such as for the Cooking or Crosswords features) to which they do not currently subscribe.
If the Class Member is entitled to receive all the New York Times’ digital subscription offerings and do not take action, they will receive a free one-month Basic Digital Access Subscription that can be shared with friends and family.
Those who have an inactive New York Times subscription and do nothing also will receive the Basic Digital Access Subscription.
In addition to the monetary relief, The New York Times Co. has agreed to revise the automatic renewal terms on its checkout pages and in direct-mail offers to be consistent with California law.
The company also will provide consumers submitting new orders for an automatically renewing New York Times subscription with an acknowledgment including the auto-renew terms, cancellation policy, and other information.
A final approval hearing in the New York Times subscription auto-renewal settlement is scheduled for Sept. 10, 2021.
The deadline to ask to be excluded from or to object to the settlement is July 24, 2021.
The deadline to file a claim also is July 24, 2021.
Who’s Eligible
Anyone who, from June 17, 2016, through May 12, 2021, enrolled in an automatically renewing New York Times subscription directly through The New York Times Co. using a California billing and/or delivery address, and who was charged and paid an automatic renewal fee or fees in connection with that subscription.

Proof of Purchase
No proof of purchase is required in order to file a claim. However, the settlement administrator may require you to submit additional documentation to validate your claim.Â
