Consumers nationwide who were customers of Caliber Home Loans and paid a fee in order to make a residential home loan payment by phone or interactive voice response (IVR) may be eligible for compensation in the form of a payment thanks to a recent multi-case Caliber Home Loans Fees class action settlement.
Settlement Class Members include all customers who held a loan through Caliber Home Loans, made a payment using the IVR system or by phone between Jan. 1, 2013, and Jan. 31, 2020, and were charged a fee to make the payment.
The current proposed settlement covers not just one class action lawsuit but three.
In these cases, plaintiffs allege the Caliber Home Loans charged various fees that violated the federal Fair Debt Collection Practices Act. The plaintiffs allege these fees were charged when consumers attempted to make payments to their mortgages either online, over the phone, or through an IVR system. These fees, the plaintiffs say, not only violated the law but also breached the terms of their borrowers’ agreements.
The company denies the allegations asserted in each of the Caliber Home Loans fees lawsuits.
Caliber Home Loans offers several options when it comes to loans and, according to its website, has helped more than 118,000 families buy homes.
The Court has not made a determination of guilt or innocence in this case. Instead, all parties have agreed the proposed settlement is in their best interests.
According to the proposed settlement, a settlement fund will be created with the purpose of paying service fees, administrative costs, Court-awarded attorneys’ fees, and direct payments to Class Members.
The exact amount of compensation each Class Member will receive will be calculated on a borrower-by-borrower basis, but each Class Member will receive an equal pro rata share.
Settlement Class Members have three options in this matter.
Class Members who wish to continue to participate in the class action lawsuit and remain a part of the Class do not need to take action. Class Members who are entitled to receive a payment will get it automatically.
The deadline for Class Members to exclude themselves from or object to the Caliber Home Loans fees settlement has passed.
A final fairness hearing is scheduled to take place on Dec. 16, 2021.
No claim form is required in order to benefit from this settlement.
