Auto-Owners Mutual Insurance Co. agreed to a class action lawsuit settlement to resolve claims that it wrongfully deducted nonmaterial depreciation from property loss payments in certain states.

The settlement benefits Auto-Owners Mutual Insurance Co. property insurance policyholders who made a structural damage claim in Arizona, Illinois, Missouri or Wisconsin during certain periods that resulted in an actual cash value payment from which nonmaterial depreciation was withheld.

The applicable class periods are:

  • For Arizona claims: Oct. 20, 2014, to present
  • For Illinois claims with a one-year suit limitations clause: May 13, 2020, to present
  • For Illinois claims with a two-year suit limitations clause: May 13, 2019, to present
  • For Missouri claims: April 27, 2012, to present
  • For Wisconsin claims with a one-year suit limitations clause: April 27, 2021, to present
  • For Wisconsin claims with a two-year suit limitations clause: April 27, 2020, to present

Plaintiffs in the class action lawsuit claim that Auto-Owners Mutual Insurance wrongfully deducted depreciation from labor costs and other nonmaterial items when paying homeowners’ insurance claims. As a result of these deductions, policyholders allegedly received smaller payments than they were owed and, in some cases, did not receive payments at all due to the amount deducted.

Auto-Owners Insurance is an insurance provider that sells home, auto, life and business insurance to consumers nationwide. 

Auto-Owners Mutual Insurance Co. hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the insurance class action lawsuit.

Under the settlement terms, class members who have not had their depreciation returned to them can receive a refund of up to 100% of the nonmaterial depreciation that was withheld from their claims. Refund percentages will vary from 50% to 100%, depending on the policyholder’s state. Each claimant will receive up to 7.15% simple interest per annum on top of their refund, meaning that they could recover payments larger than what was initially deducted from their claim.

Class members who have had their nonmaterial depreciation returned to them after it was withheld by the insurance company can receive a payment between $25 and $75, depending on the amount initially withheld.

The deadline for exclusion and objection was Dec. 13, 2023.

The final approval hearing for the settlement was held Jan. 12, 2024.

In order to receive a settlement payment, class members must submit a valid claim form by Feb. 26, 2024.
