Artech will pay up to $10,000 to each individual affected by its 2020 data breach as part of a recent class action lawsuit settlement.
The settlement benefits individuals who previously received a notice from Artech informing them they were impacted by the company’s January 2020 data breach.
Artech is a staffing company specializing in IT staffing and project services. The women- and minority-owned business touts over $775 million in global revenue. But in 2020, the company faced a ransomware data breach that affected around 30,000 current and former employees.Â
According to the settlement website, the data breach lasted from Jan. 5 to 8, 2020, during which time unauthorized hackers were able to access, open, and download thousands of Artech employee files. These files reportedly contained sensitive personal information such as names, addresses, telephone numbers, Social Security numbers, and dates of birth.
Although the breach was resolved within six hours of detection, Artech drew scrutiny over the months that passed between resolving the breach and informing affected employees of the issue.
Affected Artech employees swiftly took legal action against the staffing company after being informed of the breach, arguing that Artech failed in its duty to protect their information through reasonable cyber security measures and prompt disclosure. As a result of the data breach, current and former employees are allegedly at risk for identity theft and fraud.
Artech has not admitted any wrongdoing in the case but agreed to resolve the employee claims with a class action settlement.
Under the terms of the Artech class action lawsuit settlement, all Class Members are eligible for three years of credit monitoring and identity protection services.Â
Cash compensation is also available for Class Members who experienced fraud as a result of the data breach.Â
Tier 1 compensation includes up to $80 in payments for lost time at a rate of $26.67 per hour, capped at three hours. These payments are available for any claimant who provides documentation of time spent addressing the data breach.
Tier 2 payments include reimbursement of up to $10,000 in out of pocket losses resulting from the data breach. This includes losses as a result of identity theft or other fraud enabled by stolen data. Claimants must provide documentation for these out of pocket expenses in order to be eligible for higher payments.
The deadline for exclusion and objection is Jan. 7, 2022. Although the Artech data breach class action lawsuit settlement has received preliminary approval from the court, a final approval decision will be made at the fairness hearing, scheduled for Feb. 10, 2022.
In order to recover cash benefits from the settlement, Class Members must submit a valid claim form by Feb. 26, 2022.Â
Claimants have three months following final approval to submit a request for three free years of credit monitoring and identity protection services.
