Consumers who purchased AmeriGas or Blue Rhino pre-filled tanks may be eligible to claim up to $125 without proof of purchase as part of a $6.5 million settlement over the amount of propane in the tanks.

Those who are eligible to make a claim in this class action settlement include individuals who bought or exchanged one or more AmeriGas and/or Blue Rhino pre-filled propane tanks between Dec. 1, 2009, and Nov. 30, 2020.

Without proof of purchase, Class Members will be eligible for up to $2.50 per tank for up to 50 tanks, or $125.  Class Members who provide proof of purchase are eligible for up to $5 per tank, with no limit on the number of tanks that can be claimed.

This class action settlement resolves claims that AmeriGas and Blue Rhino allegedly colluded together to lower the amount of propane in their pre-filled propane tanks from 17 pounds to 15 pounds without also reducing the price, resulting in inflated prices for propane customers.

While consumers who purchased either AmeriGas or Blue Rhino propane tanks may be affected by this settlement, it only resolves the claims made against AmeriGas; the Blue Rhino case is continuing in court.

AmeriGas has agreed to end the litigation with this settlement, but AmeriGas does not admit to any wrongdoing. 

The settlement agreement established two Classes.

The Indirect Purchaser Settlement Class is made up of those who purchased AmeriGas or Blue Rhino propane tanks, other than a wholesale purchase directly from AmeriGas or Blue Rhino for resale, in Arizona, California, Iowa, Maine, Michigan, Minnesota, Nevada, New Mexico, North Carolina, North Dakota, South Dakota, Utah or West Virginia during the Class Period.

The Direct Purchaser Settlement Class is made up of consumers nationwide who purchased one of the propane tanks directly from AmeriGas or Blue Rhino via a vending machine at retailers or other locations, or paid one of the companies directly through a vending machine to exchange a previously purchased propane tank, other than a wholesale purchase intended for resale.

A fairness hearing is scheduled for March 31, 2021.

The deadline for filing a Claim Form, opting out or objecting to the settlement is March 8, 2021.

Who’s Eligible

Potential Award
  • With proof of purchase, Class Members will be eligible to claim a cash payment of $5 for each tank purchased. There is no limit to the number of tanks that may be claimed with proof of purchase.
  • Without proof of purchase, Class Members may claim $2.50 for each tank, up to 50 propane tanks, for a maximum of $125.
Proof of Purchase

Valid forms of proof of purchase include store receipts, credit card receipts, UPC codes from propane tank labels and store records. Consumers with something else they think confirms the purchase should submit it along with their Claim Form. The Claims Administrator will determine whether the proof is sufficient.

    I buy @ least two tanks a week for my heaters and fishing all night I can not get the form to show texas on it

    Am I the only one that doesn’t 100% understand their wording about the vending machines? Does this mean if I went into Walmart and paid for an exchange and they went outside and opened the cage and got it for me, I don’t qualify for this? I’ve purchased from actual vending machines already where you pay right there and get the tank yourself, but I usually go into Walmart. I don’t have a clue if I qualify.

      Vending machine means an AmeriGas or Blue Rhino branded machine, not a holding cage at a store. If you were purchasing from Walmart, it would be categorized as an indirect purchase and must have been made within one of the thirteen listed states.

    I would llke to be included in this claim. There are several locations that i purchased this product from but i dont see why Colorado doesnt look to be included. Your help would be appreciated. I have bought many replacement tanks throughout the years. At the very least 25-35 tanks
