A $1,076,075 class action settlement has been reached in an Illinois Albertsons biometric information class action lawsuit.

The settlement is for those individuals who used the Vocollect order-picking technology at the Jewel Osco distribution center at 1966 N. 19th Ave. in Melrose Park, Illinois, 60160, between March 1, 2018, and Oct. 17, 2022, and are not members of a labor union.

Albertsons is accused of violating the Illinois Biometric Information Privacy Act (BIPA) by using Vocollect order picking to allegedly collect, store and transfer biometric data without following the notice and consent requirements of BIPA.

Albertsons is a grocery store company that has stores in 35 states across the country. It employs individuals along its grocery supply chain throughout those states.

The settlement is designed to compensate those individuals who had their biometric information taken without prior consent. Lead plaintiff Bryan Goree will receive a $7,500 settlement award and attorneys’ fees will be less than one-third of the settlement fund; administrative fees will also be taken from the fund. 

After those deductions, the net settlement fund will be equally distributed to class members who do not exclude themselves.

The deadline to object or request to be excluded is Oct. 27, 2023.

A final fairness hearing in the Albertsons BIPA settlement will take place Nov. 15, 2023.

There is no claim form required.
