Advanced Disposal Fees Class Action Settlement

A $3 million settlement has been reached to resolve claims that Advanced Disposal charged their customers improper fees including “fuel surcharges,” “fuel/environmental fees,” “administrative fees,” and/or “service charges.”

Georgia and Alabama consumers who paid one or more Advanced Disposal fees to the waste and recycling service company can get a full refund of those fees from this class action settlement.

Three plaintiffs filed separate class action lawsuits against several Advanced Disposal companies, claiming that they were wrongly charged fees from the company. According to the class action lawsuits, Advanced Disposal did not have the right to charge certain fees to their consumers.

Advanced Disposal fees reportedly included “fuel surcharges,” “fuel fees,” “energy recovery fees,” “energy charges,” “environmental fees,” “environmental charges,” “administrative fees,” “administrative charges,” “late fees,” and “service fees.”

By settling these claims, Advanced Disposal has not admitted any wrongdoing. The company maintains that they have done nothing illegal and is only settling the fees class actions against them to avoid the costs and risks associated with continued litigation.

According to the settlement website, the $2.999 million Advanced Disposal fees settlement was reached after 10 years of litigation and seven mediation sessions. Thousands of documents and the depositions of 15 witnesses were involved in the litigation process. The Advanced Disposal fees settlement was reportedly reached thanks to the work of six separate law firms.

The settlement will provide a 100 percent refund of all Advanced Disposal fees that were improperly charged. In order to benefit from the settlement, Class Members need to file a valid claim by Nov. 4, 2019.

The deadline for exclusion and objection is Aug. 7, 2019. The final approval hearing is scheduled for Aug. 21, 2019.

Consumers from Georgia and Alabama who paid one or more Advanced Disposal fees.
