The manufacturer of Adderall XR® has agreed to pay $14.75 million to resolve allegations that the company intentionally delayed the availability of a generic version of the medication.
Lead plaintiff Monica Barba claimed that Shire U.S. Inc. and Shire LLC filed “sham patent litigations” against generic competitors of Adderall XR as well as a “sham Citizen Petition” with the U.S. Food and Drug Administration which resulted in both a delay and lessened availability of a cheaper version of the prescription drug.
In addition, the class action lawsuit accused Adderall XR manufacturer of “paying higher rebates to managed care organizations that agreed to the preferred placement of brand Adderall XR® instead of generic versions.”
Shire denied these allegations but agreed to settle the class action to avoid the cost and risk of going to trial.
The Adderall XR class action settlement will resolve Barba v. Shire U.S. Inc., Case No. 1:13-cv-21158, in the U.S. District Court for the Southern District of Florida, as well as the following cases currently pending in other courts: Allyson Netwall v. Shire U.S. Inc. and Shire LLC, E.D. Pa., Case No. 13-cv-1669; Samantha Peluso v. Shire U.S. Inc. and Shire LLC, D. N.J., Case No.15-cv-72259; and Jessica Hartenstine, Jayme Dearing, and Rosemary Autrey v. Shire U.S. Inc. and Shire LLC, D. Mass., Case No. 15-cv-14181.
Those who wish to object or be excluded from the Adderall XR settlement must do so by Oct. 7, 2016.

Ok the illiterate people trolling these articles should seriously reconsider posting.
“ok, when checks go out , TCA” is NOT a complete statement, @mari.
Please repeat grades 2 thru 10. Thanks.

Thanks Sally
Is there going to be another court date for the date checks will start to be dispersed?
I contacted the Claims Admin on April 11 to inquire about check disbursement timeline, and this was the reply:
“Good Morning,
We are currently processing and reviewing claims. In general, claims review can take 6-9 months from the filing deadline to be complete. Thank you for your patience.

That deadline was 10/07/16. May 7th was 7 months.
I received the same response last week
Just wondering if anyone has heard anything regarding checks
Anyone heard anything about when payments will begin arriving? I emailed them and got a generic msg.
maybe 2 years
How did u hear 2 years?
it was a typo. he meant to say 3 years.
I’m going to assume that’s how long it takes to exhaust appeals .. so dumb
Still nothing? This is taking forever!
Typically how long does it take for checks to be mailed?
???
when will checks be distributed?
nothing yet
Can we please have an update on what’s going on? The last update was the beginning of February, tomorrow is April 11st with no new information?
You did not read then, the last update was in March
There is nothing new to report at this time. As we stated in our last update, the unopposed motion for distribution of settlement funds did not include a timeline for check disbursement. We will let our viewers know as soon we learn that checks are in the mail.
Any updates TCA?
