A $500,000 settlement has been secured in a Sunrise Detox class action lawsuit that alleged consumers were sent unwanted text messages about the alcohol and drug rehab center.

Class Members include those in the U.S. who received a text message on their cell phone around Oct. 30, 2018 from Sunrise Detox using the Textedly platform.

The Sunrise Detox class action lawsuit alleged that the center, with locations in New Jersey, Florida, Massachusetts, and Florida, sent spam texts to consumers without their prior approval. The plaintiff alleged that the detox center had violated his and other telephone consumers’ rights under a major federal privacy law, the Telephone Consumer Protection Act.

Under the law, also known as the TCPA, companies are prohibited from calling with or, as in this case, texting advertising messages to consumers without their prior, express authorization. The TCPA was enacted in 1991 with the goal of protecting consumers from harassing telemarketers. While the law originally included telephone and fax communications, it has been updated to cover text messages, also called SMS messages.

The plaintiff in the Sunrise Detox TCPA class action lawsuit accused the company of sending advertising messages about its programs to unwitting consumers who had neither requested or approved the messages. According to settlement documents, the spam text messages were sent out on Oct. 30, 2018 and Sunrise contracted with the text messaging platform Textedly to send the messages.

Sunrise Detox denied any wrongdoing, but has agreed to pay $500,000 to end the class action lawsuit. Under the terms of the settlement, each Class Member will receive $61.97.

To make a claim in the Sunrise Detox TCPA class action settlement, Class Members file a Claim Form either online or by mail no later than Dec. 18, 2019. Class Members must provide either their claim ID from the settlement notice or the phone number that received the spam text.

In addition, Sunrise has agreed to implement policies and procedures to ensure compliance with the TCPA in the future.

The deadline for Class Members to opt out of or exclude themselves from the Sunrise Detox class action settlement is Nov. 4, 2019.

“(1) All persons within the United States (2) who were sent a text message (3) on his or her cellular telephone (4) using the Textedly platform (5) by or on behalf of Sunrise on or about October 30, 2018.”
