Macy’s Data Breach Class Action Settlement

Macy’s has reached a $257,500 settlement deal with customers, ending claims that the company did not do enough to protect against a data breach. 

The settlement offers remedy for consumer injury allegedly caused by the data breach that occurred between May 1, 2018 and June 11, 2018.

Class Members eligible for the Macy’s data breach class action settlement include customers who live in the United States and received a notification in July 2018 from Macy’s, regarding unauthorized activity that resulted from the cyber attack.

Plaintiff Anna Carroll filed the Macy’s data breach class action in 2018. She claimed that she made multiple purchases with her online Macys.com account and the company notified her on June 7, 2019 that her information had been compromised in a data breach.

According to Carroll, she was informed that a third party had likely gained access to the personal information linked to her account, including name, birthday, credit card number, and contact information.

She says that she and many other customers were financially injured because they are now vulnerable to identity theft.

Macy’s denies the customers’ claims, but agreed to settle the Macy’s class action to avoid the continued costs and risks of litigation.

The Macy’s data breach class action settlement deal notes that two types of payments are available to Class Members who submit claims for benefits by April 6, 2020, including:

• Reimbursement for documented expense related to the cyber attack, up to $1,500
• Reimbursement for undocumented time spent attempting to recover from the cyber attack, up to 2 hours at $15/hr, for a total of $30

Class Members who accept these class action settlement benefits waive their rights to pursue legal action against Macy’s over this issue.

Those who wish to be excluded from the settlement Class will not receive payment but they retain their rights to pursue independent legal action against Macy’s regarding the data breach. Exclusion requests must be submitted by Jan. 7, 2020.

Class Members may object to the Macy’s data breach class action settlement, and can write to the Court explaining why they object to the settlement deal. The deadline for objection is also Jan. 7, 2020 for electronic submissions or Jan. 3, 2020 for mailed objections. 

Those consumers who do nothing will receive no payment, and will waive their rights to pursue legal action against Macy’s over the cyber attack.

Class Members are also welcome to attend the hearing on April 30, 2020, where they can share opinions with the Court about the settlement deal.

Under the terms of the settlement agreement, claims are capped at $192,500, and the the total amount of the settlement fund will not exceed $257,500, including attorneys’ fees, administrative fees, and named plaintiff awards.

Who’s Eligible

Class Members eligible for the Macy’s data breach class action settlement include customers who live in the United States and received a notification in July 2018 from Macy’s regarding unauthorized activity that resulted from the cyber attack.

Potential Award

Up to $1,500.

The Macy’s data breach class action settlement notes that two types of payments are available to Class Members who submit valid Claim Forms, including the following:

• Reimbursement for documented expense related to the cyber attack, up to $1,500
• Reimbursement for undocumented time spent attempting to recover from the cyber attack, up to 2 hours at $15/hr, for a total of $30

Documents that prove out-of-pocket losses occurred due to the Macy’s data breach.
