Chipotle and Pizzeria Locale customers can claim up to $250 from a class action settlement ending claims that the restaurant chains put their financial information at risk.

Class Members include those who used a credit or debit card to purchase something at a physical Chipotle or Pizzeria Locale restaurant location between approximately March 24, 2017 and April 18, 2017, although exact dates depend on the store location.

Lead plaintiffs alleged in the Chipotle class action lawsuit that the company that runs both Pizzeria Locale and Chipotle Mexican Grill exposed the credit and debit card information of customers in a massive data breach affecting physical locations of the restaurant.

Chipotle failed to implement proper security measures to protect sensitive financial information from hackers, the class action states.

According to the complaint, 2,249 Chipotle and Pizzeria Locale restaurants were affected by the massive data breach in March and April of 2017.

The Chipotle class action lawsuit pointed out that, despite the recent data breaches affecting other chain restaurants, the fast casual chain neglected to implement additional security measures to protect their customers’ sensitive financial information.

In fact, the plaintiffs say that in 2015 Chipotle refused to upgrade it’s cash registers to more secure technology because it feared that the lines would be slowed down.

Under the terms of the settlement agreement, Class Members can receive two types of payment. Payments can include up to $250 reimbursement for various out-of-pocket expenses, including bank fees, costs of credit reports, and identity theft protection.

Class Members can also claim up to $25 for each fraudulent charge made on their credit or debit card related to the data breach, even if those charges were ultimately reversed.

In addition, Class Members can receive up to $10,000 in reimbursement for expenses related to the loss of personal information related to the Chipotle data breach. The settlement deems these costs “extraordinary” and Class Members must demonstrate that they were related to the data breach and reasonable efforts to get reimbursement must be sought before making the settlement claim.

Class Members must submit a Claim Form either online or via mail. Documentation of expenses or fraudulent charges, along with either the first or last four digits of the credit or debit card exposed in the breach or documentation that reflects use of the card at a Chipotle or Pizzeria Local location during the data breach must be included.

Customers have until Nov. 16, 2019 to opt out of or exclude themselves from the Chipotle class action settlement.

Who’s Eligible

Class Members include those “in the United States and used a credit or debit card to make an in-store point-of-sale purchase (online payments were not affected) at an affected Chipotle or Pizzeria Locale restaurant while payment card data at the store was at risk. Class Members must have had out-of-pocket expenses, fraudulent charges, lost time spent dealing with fraudulent charges or card replacement issues, or unreimbursed extraordinary monetary losses as a result of the Chipotle Security Incident.  The time frame of the incident is generally from March 24, 2017 through April 18, 2017, although the specific dates during which data was at risk vary on a store-by-store basis.”

Potential Award

Up to $250, although some Class Members may be able to claim up to $10,000.

Proof of Purchase

Proof of a credit or debit use at a Chipotle or Pizzeria Locale restaurant, along with proof of out-of-pocket expenses related to the data breach.

      I contacted them in March and received an email back on March 20, 2020…”We are still finalizing claims and have sent letters requesting documentations to some class members. We do not yet have a distribution date or confirmed list of approved claims.”
