A $1.3 million settlement will resolve a class action lawsuit alleging Metagenics food products are falsely advertised as being able to treat medical conditions such as diabetes, cardiovascular problems, fatigue, and even bowel problems.

If you purchased a Metagenics product labeled as “Medical Food” including UltraMeal Plus, UltraMeal Plus 360, UltraGlycemX, and UltraClear since Nov. 9, 2011, you could get cash from this settlement.

Metagenics is a global nutrigenomics and lifestyle medicine company which sells 17 different types of “Medical Foods” for upwards of $150 per container.

Lead plaintiff William Grivas contends that he and other consumers were duped into thinking food products manufactured and sold by Metagenics were able to provide health benefits since they were marketed as “Medical Foods.”

The plaintiff accuses Metagenics of capitalizing on consumers with health problems by advertising these products as able to treat and correct problems including “metabolic syndrome,” “compromised gut function,” “leaky gut syndrome,” and others.

According to the Metagenics medical foods class action lawsuit, the advertising violated California consumer protection laws.

Medical foods, according to the plaintiff, must be specifically formulated and administered by a physician. Metagenics’ so-called medical foods are mass produced and not tailored to a particular patient’s condition.

Under the terms of the Metagenics medical foods class action settlement, Class Members can make a claim for up to five products purchased without proof. Class Members who have proof of purchase, including receipts, can submit claims for additional products. Claims can be submitted online or Class Members can print and mail a Claim Form.

The settlement administrator will divide the settlement award by the number of valid claims and each Class Member’s claim will depend on the number of products purchased.

Class Members have until March 17, 2019 if they want to object to the settlement or ask to be excluded from its terms.

Who’s Eligible

Class Members include U.S. residents who purchased Metagenics products that were labeled “Medical Food” since Nov. 9, 2011. Metagenics products include UltraMeal Plus, UltraMeal Plus 360, UltraGlycemX, and UltraClear.

Potential Award

To be determined. Each Class Member’s award will depend on the number of products purchased and the number of valid claims submitted.

Proof of Purchase

Class Members can submit claims for up to five products without proof of purchase. Class Members submitting claims for more than five products need to provide proof of purchase, such as receipts.
