A $22 million settlement has been reached to resolve a consolidated class action lawsuit regarding the 2015 Experian data breach.

Personal information compromised in the breach may have included names, addresses, Social Security numbers, dates of birth, identification numbers (driver’s license numbers, military ID numbers, or passport numbers), and other information.

Plaintiffs in the consolidated class action claimed that Experian failed to adequately protect the personal information of about 15 million consumers.

The consolidated Experian class action lawsuit claims the credit reporting agency “willfully ignored known weaknesses in its data security, including prior hacks into its information systems.”

According to the Experian class action, personal identifying information was available for sale on the dark web shortly after the security breach.

Plaintiffs allege that because of this massive breach, they will have to continually monitor their financial accounts as they are at an increased risk of identity theft.

Experian does not admit any wrongdoing by settling the case, but the $22 million class action settlement provides consumers the chance to recover compensation for injuries allegedly sustained from the Experian data breach.

Under the settlement, a variety of compensation options are available. All Class Members have access to two years of free credit monitoring and insurance services as well as up to $40 in a default time award.

With additional documentation of time spent mitigating damage from the Experian data breach, consumers can collect $20 per hour, up to 7 hours, totaling up to $140 for a documented time reimbursement.

Class Members can also receive a cash payment of up to $10,000 to compensate them for any out-of-pocket costs associated with the Experian data breach and the aftermath.

Class Members have until April 11, 2019 to submit a valid claim through the settlement website or printed from the website and mailed to the settlement administrator.

Attorneys for the Class will ask for up to $10.5 million in attorneys’ fees and up to $350,000 in court costs. Each of the 57 Class representatives will receive $2,500 service awards.

Class Members who want to exclude themselves from the Experian class action settlement terms must do so in writing no later than March 27, 2019.

Who’s Eligible

Consumers who received an Experian data breach notice in October 2015.

Potential Award

Up to $40 in a default time award and two years of free credit monitoring and insurance services. Further cash compensation is available to reimburse time ($20 per hour, up to 7 hours) and out-of-pocket costs (up to $10,000).

Proof of Purchase

Reasonable documentation required to recover compensation for out-of-pocket costs including bank or credit card statements, receipts, invoices and phone records.

    I was supposed to be getting credit monitoring from Experion, then my T-mobile phone was remotely turned off, I had to buy another phone after being unable to get my phone turned back on. I now am paying for new phone, had to get new email, and my name, soc sec number, driver’s license, old phone are on the dark web. I had to put a freeze on my credit report, info in my mychart for healthcare has been changed, my primary care physician noticed unusual notes and still cannot get back some of my social media accounts.

    I filed in 2019 for a settlement because my checking accounts took a big hit and has continued to be breached to this day (2022, December). I am still fighting to keep hackers out of my accounts. I can no longer have a debit card from my bank for a year. What happened to the promises of fair settlement practices after the case was settled?
