One Nevada Credit Union has agreed to pay $600,000 to settle claims that they wrongfully accessed consumer credit reports.
According to plaintiff claims against One Nevada, the credit union’s actions violated the Fair Credit Reporting Act (FCRA). One Nevada would allegedly access consumer credit reports while conducting “Account Review Inquires.”
The $600,000 settlement was reached through private mediation in October 2017. Class Members in the One Nevada settlement include those who were members of the credit union on or after Sept. 13, 2011.
Class Members have until Jan. 24, 2019 to submit a valid Claim Form, which can be submitted through an online form or printed from the settlement website and mailed to the settlement administrator.
Class counsel intends to ask for up to 30 percent of the settlement fund to cover attorneys’ fees and court costs. Lead plaintiff Joseph Smith will receive a payment of up to $5,000 for his services as Class representative.
After these and other costs are deducted, the net settlement fund will be equally distributed among Class Members who file a valid claim. The exact payment each Class Member will receive will depend on how many valid, timely Claim Forms are submitted.
If Class Members disagree with the settlement or wish to take legal action independent of the settlement, they will need to exclude themselves.
Even if consumers do not file a Claim Form, failing to exclude themselves from the settlement will bind them to the terms of the agreement and prevent them from taking legal action on their own in the future.
Class Members can exclude themselves by contacting the settlement administrator with an exclusion request by Jan. 24, 2019.
One Nevada does not admit any wrongdoing by settling the class action lawsuit against them. Instead a settlement provides a way for both the credit union and consumers to resolve the legal claims without the costs and risks associated with continuing litigation through a trial verdict.

Class Members include those who were a member of One Nevada on or after Sept. 13, 2011.

The $600,000 settlement fund will be distributed equally to Class Members who file a valid claim after legal expenses have been paid. The actual amount each consumer receives is unknown at this time.

I got a notice from Informed Delivery that it would be delivered Thursday, July 18, but it wasn’t. I received another notice on Friday, July 19 that it would be delivered, but it wasn’t. I told the Letter Carrier in person on Friday and he checked, but unable to locate. Today, Saturday, July 20, no notifications from USPS on it’s status. How long should I wait before bringing it to someone in the Settlement Group that it’s more than likely lost? If anyone has advice, I would appreciate it very much.

I notified the USPS and they delivered the check today. Give it a few days and if you haven’t received it, notify them. They will give you a case number and will look into it immediately.
