The checks are arriving for the Ross Stores Class Action Lawsuit Settlement (McGee v Ross Fund) and WHAT a settlement it is! We knew it was a cash settlement, but, not exactly how much you’d receive. Details: Did you purchase someone from Ross or DD’s Discounts department stores sometime between January 1, 2005 – February 22, 2007 using a credit card? If so, you may be eligible to submit a claim for your piece of ~$800,000 to be distributed to claimants. You need to go here and print out the claim form. Fill it out, as completely as possible, and send it in by January 2nd, 2009. It MUST be postmarked by that date. Don’t remember what date you purchased the item or what credit card was used? Your claim won’t be denied according to the settlement agreement. The settlement agreement states “The Claim Form shall not be denied because a Settlement Class member does not know or cannot determine the correct las four digits of the card number that was used to make a purchase between January 1, 2005 and February 22, 2007. Nor shall the claim form be denied because a Settlement Class member does not know or cannot determine the correct date of purchase.” In that case, our opinion is that you’ll want to leave those items blank, making sure to sign and date the bottom of the claim form stating you made the purchase. TCA Staff Tidbit: At first our opinion of this settlement was BLAH! Only a little more then a million dollars total, with ~$800,000 going to the affected Class? Yuck. I mean, how many people remember the exact date when they made a purchase at a department store a few years ago, along with what credit card they used? A show of hands please. . . Yeah, thought so, we didn’t think you remembered either. This got INTERESTING after reading the entire settlement agreement. First off, this is a CASH disbursement! No discounts, coupons or giveaways. The claimants will receive a check for cold hard cash. That’s Nice! Second, the agreement states that they won’t deny the claim if you don’t remember what date you made your purchase on or what card you used. WOW! That’s great! The only bummer is you have to submit a paper claim, electronic submission isn’t available. So, get those printers printing, grab a stamp and an envelope, and get those claims submitted!
