Those who received unwanted text messages from a Telenav phone number may benefit from a $3.5 million class action settlement resolving allegations that the company violated the Telephone Consumer Protection Act (TCPA).

Lead plaintiffs allege that Telenav sent numerous unwanted text messages touting their app called “Scout.” The plaintiffs claim that Telenav continued to send the messages even when they attempted to stop or unsubscribe from the unwanted contact.

According to the Telenav class action settlement, those who received messages sent between July 28, 2012 and March 5, 2018 may be entitled to an award.

In 1991, Congress enacted the TCPA to protect consumers from harassment from companies by phone and fax. The Act was extended to include unwanted text messages to mobile phones and devices. Under the TCPA, companies who are found to have violated the Act can be hit with fines of up to $1,500 per violation. The total statutory fine can be substantial if the company made millions of unwanted phone or text communications in violation of the TCPA.

Telenav has agreed to pay Class Members who received the initial allegedly unwanted text message, as well as another award to Class Members who attempted to opt out of the messages, but continued to receive texts. There are an estimated 200,000 Class Members.

The company admits no wrongdoing under the terms of the Telenav class action settlement.

The deadline for Class Members to either object to or exclude themselves from the Telenav class action settlement is Aug. 16, 2018.

Who’s Eligible

Class Members include those who received one of the following messages from Telenav with a link between July 28, 2012 and March 5, 2018;

  • “Download Scout to send notifications”
  • “Connect with [NAME] by downloading Scout”
  • “To see [NAME]’s progress and communicate, download Scout”
  • “Welcome to Scout! [NAME] is using Scout to talk about, plan, and navigate to Meet Ups”
Potential Award

Up to $9,000, depending on the number of valid claims submitted.

“Class Members who submit Valid Claim Forms and who are part of the No Consent Subclass according to Telenav’s records will be eligible to receive one (1) Award Unit from the Net Settlement Fund, up to a maximum of $1,500.00 USD. Settlement Class Members who submit Valid Claim Forms and who are part of the STOP Subclass according to Telenav’s records will be eligible to receive five (5) Award Units from the Net Settlement Fund, up to a maximum of $7,500 USD. Settlement Class Members who submit Valid Claim Forms and are members of both Subclasses will be eligible to receive a total of six (6) Award Units from the Net Settlement Fund, up to a maximum of $9,000 USD. All Award Units will be of equal value, and the actual value of each Award Unit will depend upon the number of Valid Claim Forms submitted and approved.”

    ami tampoco a la fecha me ha llegado nada de el dinero de la demanda de telenav y lo envié por correo parece que se quieren quedar los abogados con nuestro dinero pero si ellos no me dan mi dinero yo los voy a demandar ,y ni cojen los teléfonos que tienen para uno comunicarse.
