Guess text spam settlement

A settlement has been reached in a class action lawsuit alleging Guess? Inc. and Guess? Retail Inc. deceptively advertised false reference prices on merchandise sold in Guess Factory stores in the state of California.

If you shopped at a Guess Factory Store in California between April 17, 2011 and Feb. 26, 2018, you may be entitled to benefits from the outlet store pricing class action settlement.

On April 17, 2015, plaintiff Serena Adame filed the first Guess outlet pricing class action lawsuit accusing the retailer of advertising deceptive reference prices for merchandise sold at Guess Factory stores, leading consumers to believe they are receiving a discount. Later that month, plaintiff Versil Milton filed a similar deceptive pricing class action lawsuit against the Guess defendants.

A third Guess outlet pricing class action lawsuit was filed by plaintiff Shiloh Borsh in May 2016, and her complaint was consolidated with the Adame/Milton class action lawsuit.

The plaintiffs allege that Guess outlet stores sell different merchandise than their retail counterparts, but fail to inform consumers of this fact. According to the Guess class action lawsuits, Guess places tags on products sold at its California outlet locations with an alleged “retail price,” and then sells the items at a lower price.

However, the so-called “retail price” is not reflective of the price at which the item has ever been sold, the plaintiffs allege. Instead, the “retail price” is an inflated price that Guess places on the product to cause consumers to think they are receiving a bargain.

Guess denies the allegations and maintains it did nothing wrong. However, it has agreed to settle the outlet store pricing class action lawsuit to avoid the cost of trial. The Guess class action settlement was preliminarily approved on Feb. 28, 2018.

Class Members who would like to opt out of or object to the Guess Factory store pricing settlement must do so no later than June 11, 2018.

Who’s Eligible

Class Members of the Guess outlet store settlement include anyone who, between April 17, 2011 and Feb. 26, 2018, purchased an item from any Guess Factory store in the state of California that had a higher reference price displayed.

Potential Award

$4 – $30 in vouchers.

Class Members may file a claim to receive a Guess Factory store voucher for $4, $8, $9 or $12 off any purchase, or $5 off a purchase of $20 or more or $10 off a purchase of $35 or more. The amount each Class Member is entitled to receive depends on whether they qualify as Tier 1, Tier 2, Tier 3 or Tier 4 Authorized Claimants.

Tier 1 Authorized Claimants: Includes Class Members who do not submit proof of qualifying purchases with their Claim Form, or who submit proof of qualifying purchases that are less than $25. Tier 1 Authorized Claimants are entitled to a $4 voucher or $5 off a purchase of $20 or more.

Tier 2 Authorized Claimants: Includes Class Members who submit proof of purchase for qualifying purchases totaling $25.01-$75. Tier 2 Authorized Claimants are entitled to an $8 voucher or $10 off a purchase of $35 or more.

Tier 3 Authorized Claimants: Includes Class Members who submit proof of purchase for qualifying purchases totaling $75.01-$250. Tier 3 Authorized Claimants are entitled to either one $9 voucher or two vouchers each good for $10 off a purchase of $35 or more.

Tier 4 Authorized Claimants: Includes Class Members who submit proof of purchase for qualifying purchases totaling more than $250.01. Tier 4 Authorized Claimants are entitled to one $12 voucher or three vouchers each good for $10 off a purchase of $35 or more.

NOTE: If you received direct notice of the Guess class action settlement, you will automatically receive one $8 voucher unless you file a timely and valid Claim Form or exclude yourself from the settlement.

Proof of Purchase

None required. However, Class Members who submit proof of purchase may be entitled to higher-valued benefits from the Guess outlet pricing settlement, depending on the total value of their qualifying purchases.

    TCA any updates on this??? One person says they got $4 voucher, but no one else seems t have gotten one….. Do we know if they have sent out vouchers??

    11/28/18 Received $4 voucher in Missouri. Good for purchase to use in a Guess Outlet Store in California only.

      Wow, that’s not fair… they should have sent you the $4.00 What about if you never come to California? So far I am in CA nothing yet.

    As described in Questions 18 and 19, the Court held a hearing on August 7, 2018 at 8:30 a.m. to decide whether to approve the Settlement. The Final Order and Judgement, which approved the Settlement,can be located here. Vouchers will be distributed after the Settlement Effective date of October 10, 2018. Please be patient.

    What type of voucher is this? Is this for Guess Factory Store only?
