wish-com

Consumers who were duped by Wish.com pricing that listed a fake “original” or “regular” price and corresponding discount can claim a cash award under a recent settlement agreement.

Wish.com sells a number of retail items through its website. Consumers who purchased an item through Wish.com between June 16, 2013 and Dec. 12, 2017 can receive up to $20 cash. According to settlement documents, there are nearly 22 million consumers who qualify as Class Members, making the potential value of this settlement more than $100 million.

The settlement resolves a class action lawsuit that alleged Wish.com tricked consumers into thinking they were getting a deal on items sold through its website. Lead plaintiffs Sherhonda Golden and Denise Valencia, said they they and other consumers fell for the alleged false advertising and paid more for items they purchased on Wish.com than they would have otherwise.

The Wish.com class action lawsuit alleged that by including a false “original” or “regular” price along with a supposed discount, Wish.com violated Missouri and California consumer protection laws and were also unjustly enriched.

Wish.com does not admit any liability under the terms of the class action lawsuit, but will pay between $3 and $20 to consumers who submit a claim. Class Members who can provide proof of purchase can receive up to $20, while those who do not have proof can claim $3.

Class Members can object to the settlement or exclude themselves by submitting a written request by March 2, 2018.

Who’s Eligible

Class Members include those in the United States who purchased products from Wish.com at a discount off the stated “original” or “regular” price between June 16, 2013 and Dec. 12, 2017, and who have not received a refund or credit for their purchases.

Potential Award

$3 – $20 depending on proof.

Proof of Purchase

Class Members who provide proof that the products they purchased were advertised for sale by another retailer within 90 days of the date of their purchases, using lower reference prices than advertised on Wish.com can receive up to 25 percent of the difference between the advertised reference price on Wish.com and the other retailer’s price up to a maximum of $20 per household.

Class Members who do not provide proof of purchase will receive $3.

I ordered 0ver 40 electric bikes and scooters from wish.com between late june and early july 2021. Wish.com has not delivered a single one to me yet.

First they said it’s taking longer than usual to ship. After a while I sent them an angry message on the platform and low and behold all these tracking numbers started popping up for my orders.

I thought it was weird, but I was relieved that I had a delivery date for my electric bikes so I thought nothing of it.

Next I started getting all these notifications from the wish app saying my packages had been delivered. But when I looked at the tracking info it showed that the package was delivered to an address I don’t live at, in a state I don’t live in.

I contacted wish and thet said ” your order is still in the delivery window. Don’t worry it’s coming.” I tried to tell them the app says it came but they reassured me so I said ok.

After that the same thing happened to all of my electric bike orders one by one.

I contacted the shipping company to ask them what was going on and they informed me that every single tracking number I was given from wish.com was not for my actual orders. And none of the tracking numbers I gave them for my packages, that said they were already delivered, had electric bikes in them.

If that happened to one or two orders you’d think they made a mistake. But they gave me dozens of incorrect tracking numbers for every single electric bike and scooters I ordered.

I believe that they gave me fake tracking numbers because they never actually shipped any of the bikes in the first place.

Isn’t that fraud? What can I do?

There may be a need for another class action lawsuit. I am no lawyer, but I did take Tort I and Contracts I (for my job) back in 2009, and it seems that just knowing the basic fundamentals of contract law, this business is running an illegal online business.

I always use a credit card for online purchases. I ordered three items in April, one item in May. The items in April is fishing lures, not yet arrived. The item in May (this month) is a pair of boots, originally priced on their site at $8.00 + $11.00 shipping. The next day my credit card was charged $34.00. Either Wish or the supplier increased the pricing from $8.00 to $22.00 for the pair of boots. I worked as a budget analyst with contractors for eight years and I know for a fact that this action is illegal.

Whether I can eat the mere $50.00 total costs of the stuff that I order (assuming nothing will arrive), other folks cannot eat the cost and have apparently lost much more than I have. I would also suspect that there is a reasonable time period in which orders need to be completed, not continually pushed back. It is not the customer’s fault, nor their problem, that orders from China are delayed or cannot be shipped at all. These are issues that Wish needs to overcome and deal with, not give customers excuses. Wish is soley responsible for the listing of products, pricing of products being listed, the actual costs being charged to a customer (and making sure the actual charges match the given price in the ad), and shipping in a timely manner, not two, three, or four months out. They cannot merely say, “Oh we just run a website, that it out of our hands”. Wish is responsible for the entire process.

After reading many complaints about Wish’s online business model, how is it this company still in business? Or maybe the answer is we need smarter lawyers.

  5. John rains rainsjohn says:

If they’re getting 36 billion or whatever it is one of the lawyers taken 30 million. You say the people who are eligible for a claim or only going to get three to $20 out of 36 million. People shouldn’t be so greedy

  6. Karen S. Pujale says:

    I ordered a camera 3 times never seen it . A wig 3t

  7. Bobbie J Sutton says:

I have been ordering with Wish for a few years now. Recently I ordered a TV bracket to hang my TV on the wall. The one I ordered had the wrong hole pattern, Wish refunded my money including shipping no problem. I then ordered a second one again same problem, my fault and and Wish refunded my money including the shipping within a day. I may be the only one happy with Wish, but I am indeed very happy. Thank you Wish!
